Chairperson Dewberry called the meeting to order at 7:00 PM and noted for the record that seven (7) Commissioners were present.

F. PUBLIC HEARING:
(3) Consider Case Z-1237-12; a rezoning request from Light Industrial (LI) to General Retail (GR). The property in question is located at 2010 N. Hampton Road and consists of 5.333 acres. The applicant is Tim Maiden/ First National Bank.

Commissioner McDonald recused himself from hearing and voting on case Z-1237-12.
Mr. Edlyn Vatthauer, Planning Manager, presented the management report for Case Z-1237-12.
Chairperson Dewberry asked the Commission if there were any questions of staff.
The Commission and staff discussed the legal non-conforming status of the First National Bank, if the proposed zoning change was denied. They also discussed the zoning history of the property in question.
Chairperson Dewberry asked the Commission if there was any other discussion. Hearing no response, he opened the public meeting and asked the applicant to come forward to address the Commission.
Mr. Tim Maiden, of 1519 South Greenstone, Duncanville, came forward to address the Commission. He informed the Commission that First National Bank was trying to secure leases for the property. Mr. Maiden also mentioned that the bank has been operating as a commercial bank for the last four years at the site in question. He also informed the Commission that he was available for any questions.
Chairperson Dewberry asked the Commission if there were any questions for Mr. Maiden. There being no response, he asked if there was anyone else who wished to speak either in favor of or in opposition to case Z-1237-12. Hearing no response, Chairperson Dewberry declared the public hearing closed and asked the Commission if there was any discussion.
There being no response from the Commission, Chairperson Dewberry asked for a motion.

There being no response, he opened the public hearing and asked if there was anyone who wished to speak either in favor of or in opposition to case Z-1238-12. Hearing no response,Chairperson Dewberry asked the Commission if there was any discussion or questions for staff. Hearing none, he asked the Commission for a motion.
