F. PUBLIC HEARING:
(6) Consider Case Z-1234-12; a rezoning request from Single Family Residential 10 (SF-10) to General Retail (GR). The property in question is located at 745 Belt Line Road and consists of 1.208 acres. The applicant is Frances Selby.
Management Report for Case Z-1234-12
Mr. Edlyn Vatthauer, Planning Manager, presented the management report for Case Z-1234-12.
Chairperson Dewberry asked the Commission if there were any questions of staff.
Mr. Jones asked Mr. Vatthauer if the 7-Eleven convience store was within 200 feet of the property in question.
Mr. Vatthauer informed the Commission that the 7-Eleven convenience store was within 200 feet of the property in question.
Chairperson Dewberry asked the Commission if there were any other questions of staff. There being no response, he opened the public hearing and asked for Ms. Frances Selby, applicant, to come forward to address the Commission.
Ms. Frances Selby, of 1614 Ridge Court, Midlothian, came forward to address the Commission. She provide a brief history about the property.
Mr. Bobby Flewellen, of 119 N. Polk Street, came forward to speak in opposition to Case Z-1234-12.
Mrs. Tannia Flewellen, of 119 N. Polk Street, came forward to express her concerns about general retail zoning in close promixity to her home. She also informed the Commission that she was raising a special needs child and he requires a quiet environment.
Chairperson Dewberry asked if there was anyone else who wished to speak either in favor of or in opposition to Case Z-1234-12. Hearing no response, he closed the public hearing and asked the Commission if there was any discussion.
Commissioner Jones asked if there was any opposition from the subdivision across the street from the property in question.
Chairperson Dewberry informed the Commission that there were no other notices of opposition to the proposed rezoning of the property in question.
Chairperson Dewberry stated that the property in question should not be two completely different types of zoning. He also informed the Commission that the highest and best use would be general retail.
Commissioner Jones asked if a masonry wall would be required to separate the general retail use from the residential use to the north and west.
Chairperson Dewberry informed the Commission that a 6 foot masonry wall would be required on both the north and west sides of the property.
The Commission and staff discussed the type of uses that would be allowed under general retail zoning.
Chairperson Dewberry asked the Commission if there were any additional questions or discussion. There being no response, he asked the Commission for a motion.
