Chairperson Simerly called the meeting to order at 7:00 PM and noted for the record that seven (7) Commissioners were present.

F. PUBLIC HEARING:
(3) Consider Case Z-1223-11; a request for a Specific Use Permit. This SUP would allow a restaurant with Drive-Thru window in Planned Development 95 (PD-95). The property in question is located at 118 S. Cockrell Hill Road and consists of 0.49 acres and 1 lot. The applicant is Hasmukhlal Vankawala.
Mr. Edlyn Vatthauer, Planning Manager, presented the management report for case Z-1223-11.
Chairperson Simerly asked the Commission if there were any questions of staff. There being no questions of staff, Chairperson Simerly opened the public hearing and asked the applicant to come forward to address the Commission.
Mr. Hasmukhlal Vankawala, of 6732 Lakeshore Drive, Dallas, came forward to address the Commission.
Chairperson Simerly asked the Commission if there were any questions for Mr. Vankawala. Hearing no response, he asked if there was anyone who wished to address the Commission either in favor of or in opposition to case Z-1223-11. There being no response, he closed the public hearing and asked the Commission if there were any comments or discussion. There being no response, he asked the Commission for a motion.

Chairperson Simerly asked the Commission if there were any questions of staff. Hearing no response, Chairperson Simerly opened the public hearing and asked the applicant to come forward to address the Commission.
Mr. Randy Gaubert, of 2508 Scenic Court, Cedar Hill, came forward to address the Commission.
Chairperson Simerly asked the Commission if there were any questions for Mr. Gaubert.
Commissioner Jones asked Mr. Gaubert about the type of medical use that is proposed for the property in question.
Mr. Gaubert explained that the proposed use would be a pediatric doctor's office.
Chairperson Simerly asked the Commission if there were additional questions for Mr. Gaubert. There being no response, he asked if there was anyone who wished to address the Commission either in favor of or in opposition to case SP-646-11. Hearing no response, he asked the Commission if there was any additional discussion or comments. There being no response, he asked the Commission for a motion.

(5) Consider Case SP-647-11; a Site Plan for Lot 3C South Meadows Office Park No. 2, located 536 E. Pleasant Run Road. The property in question consists of 2.2896 acres and 1 lot. The applicant is Barclay Construction/ Randy Gaubert.

Chairperson Simerly asked the Commission if there were any questions of staff. Hearing no response, he asked the applicant to come forward to address the Comission.
Mr. Gaubert, of 2508 Scenic Court, Cedar Hill, came forward to address the Commission. He explained that two different doctors were interested in the proposed building on Lot 3C, but there were no contracts on the building yet.
The Commission, staff and Assistant City Attorney Julie Pandya discussed the address of the proposed building on Lot 3C.
Chairperson Simerly asked the Commission if there were any other questions or comments. Hearing no response, he opened the public hearing and asked Mr. Gaubert to come forward to address the Commission again.

Commissioner Chambers asked if all two buildings in the general vicinity to the newly constructed law office would have similar elevation styles.
Mr. Gaubert informed the Commission that the elevations of the proposed two buildings would be similar to the newly constructed law office. He also explained that he wanted a more cohesive look to the office buildings. Mr. Gaubert stated that the roof pitch would be similar, along with the elevations but the stone and brick colors might vary slightly.
Commissioner Jones asked Mr. Gaubert to clarify the type of doctors that were interested in the proposed building on Lot 3C.
Mr. Gaubert informed the Commission that one doctor works as a chiropractor and the other doctor is a orthopedic surgeon.
Commissioner Williams expressed his concern about the one (1) handi-cap parking space available for the proposed building on Lot 3C.
The Commission, staff, Assistant City Attorney Julie Pandya and Mr. Gaubert discussed the requirement for handi-cap parking spaces.
