Chairperson Simerly called the meeting to order at 7:00 PM and noted for the record that seven (7) Commissioners were present.

(2) Approval of the Minutes for the Regular Meeting on November 23, 2010.
Motion to Approve to Approve the Minutes for the Regular Meeting on November 23, 2010 with modifications noted during the worksession. Moved by Vice Chairperson Donald Dewberry, seconded by Commissioner Dick North.

F. PUBLIC HEARING:
(3) Consider Case Z-1216-10; a Planned Development located east of Hampton Road, and generally along Peregrine & Seahawk. This area is currently zoned Light Industrial (LI). The Planned Development will have a base zoning of Light Industrial with a deviation to allow the uses Soap & Cleaning Compound Manufacturing; Turbine & Turbine Generator Set Units Manufacturing; and Urethane & Other Form Product (except Polystyrene) Manufacturing by-right on properties where the uses currently exist. The applicant is City of DeSoto.
Mr. Edlyn Vatthauer, Planning Manager, presented the management report for Case Z-1216-10 and he introduced Mr. Daniel Harrison, Freese & Nichols Consultant.
Mr. Harrison summarized the history and intent of the proposed 3rd Industrial Area Planned Development (PD-147). He also informed the Commission that the proposed Planned Development would have a base zoning of Light Industrial (LI) Zoning. Mr. Harrison stated that PD-147 would allow the three existing Industrial District Uses in PD-147. The three allowed existing Industrial District Uses include Solar Turbine (Turbine and Turbine Generator Set Units Manufacturing), ZEP Manufacturing (Soap and Cleaning Compound Manufacturing), and Diab Group (Urethane and Other Foam Product Manufacturing).
Chairperson Simerly asked the Commission if there were any questions of staff.
Commissioner Chambers asked Mr. Harrison if the three existing uses (Solar Turbine, ZEP Manufacturing and Diad Group) could relocate to any Light Industrial Zoning area in the city.
Mr. Harrison informed the Commission that the three existing uses could not be relocated to any Light Industrial Zoning areas in the city, but they could be relocated to the Industrial Zoning areas.
The Commission and staff discussed the terms of expanding the three existing uses in the proposed Planned Development (PD-147).
Chairperson Simerly asked the Commission if there were any other questions of staff. There being no response, he opened the public hearing and asked if there was anyone who wished to address the Commission either in favor of or in opposition to Case Z-1216-10. Hearing no response, he closed the public hearing and asked the Commission if there was any discussion or comments regarding Case Z-1216-10.
Commissioner McDonald stated that schools and churches are currently permitted in the proposed Planned Development and these uses are not compatible with the three existing uses currently located within the proposed Planned Development. He also informed the Commission that he would be opposed to schools and churches being allowed in the proposed Planned Development and the City Council should review which zoning districts these uses are allowed.

Chairperson Simerly asked the Commission if there was any further discussion regarding Case Z-1216-10.
The Commission, staff and Ms. Julie Pandya, Assistant City Attorney, discussed whether or not the existing businesses would be legally required to change production or safety requirements if churches or schools started moving in the proposed Planned Development.
Chairperson Simerly asked the Commission if there were any other comments or questions. Hearing no response, he asked the Commission for a motion.
