Chairperson Simerly called the meeting to order at 7:00 PM and noted for the record that six (6) Commissioners were present.

(2) Approval of the Minutes for the Regular Meeting on September 28, 2010.
Motion to Approve to Approve the Minutes for the Regular Meeting on September 28, 2010. Moved by Vice Chairperson Donald Dewberry, seconded by Commissioner Dwight Chambers.

F. PUBLIC HEARING:
(3) Consider Case Z-1210-10; a Planned Development for a childcare center (PD-146) located on The Meadows Parkway and Pleasant Run Road. This area is currently zoned General Retail (GR). The Planned Development will have a base zoning of General Retail with deviation requests for area requirements and lot size. The area in question consists of 3.16 acres and 2 lots. The applicant is Jay Childs.
Mr. Edlyn Vatthauer, Planning Manager, presented the management report for Case Z-1210-10.
The Commission and staff discussed the new common access easement for both facilities and the access easement to the north of the proposed facility.
There being no further questions or discussion, Chairperson Simerly opened the public hearing and he asked if there was anyone that wished to speak either for or against case Z-1210-10. Hearing no response, Chairperson Simerly closed the public hearing and he asked the Commission if there were any additional comments or discussion.
Commissioner Dewberry stated that he was concerned with parents making u-turns at the corner of The Meadows Parkway and Peach Lane, as well as, u-turns at the south access. He requested that staff conduct a traffic study to determine whether "No U-Turn" signs would be necessary, for safety purposes, at the intersection of the driveway just north of this property and at the intersection at The Meadows Parkway & Peach Lane.
Chairperson Simerly asked the Commission if there were any other comments or questions. Hearing no response, he asked the Commission for a motion.
Motion to approve Case Z-1210-10; a Planned Development for a childcare center (PD-146). Moved by Vice Chairperson Donald Dewberry, seconded by Commissioner Dick North.
The Motion passed unanimously with the following stipulations:
(1) The total tract to be 25,153 square feet rather than 40,000 square feet.
(2) Allow the depth of the south part of the tract to be 148 feet, rather than 200 feet.
(3) Allow the tract to have a width of 132 feet, rather than 200 feet.
(4) Treat the large lot to the west of The Meadows Parkway as a straight retail lot in that the PD does not have to be amended to incorporate the Site Plan, Landscape Plan and Elevations.
(5) Request that staff conduct a traffic study to determine whether u-turns (traveling north and then making a u-turn to go south) should be allowed at the intersection of the driveway just north of this property and The Meadows Parkway and at the intersection of Peach Lane and The Meadows Parkway.
(6) A common access easement be provided adjoining the proposed drive out to The Meadows Parkway, so that the lot to the south may use this drive for an exit as well.

(4) Consider Case CP-006-10; an amendment to the City of DeSoto Comprehensive Plan. The proposed change would amend the Thoroughfare Plan by removing Chalet Drive from the thoroughfare plan between Gannon & Wintergreen Road.

There being no response, he opened the public hearing and he asked if there was anyone else that wished to speak either for or against Case CP-006-10. Hearing no response, he closed the public hearing and he asked the Commission for a motion.
Motion to approve Case CP-006-10; an amendment to the City of Desoto Comprehensive Plan. Moved by Commissioner Scott McDonald, seconded by Commissioner Dwight Chambers.
The motion passed unanimously.

(5) Consider Case Z-1214-10; a request to amend Planned Development 20 (PD-20) for an office-warehouse mixed use center. The base zoning is general retail (GR) with a deviation request to permit a mini-warehouse with caretaker quarters. The property in question consists of 12 acres and is located on Wintergreen Road and west of I-35 E. The applicant is Don Valk.

The Commission and staff discussed how the removal of Chalet Drive from the thoroughfare plan between Gannon & Wintergreen Road would effect the proposed office-warehouse mixed use project.
Commissioner Chambers asked Mr. Vatthauer to explain how much of the proposed development would be retail use. He also asked if the first phase of the proposed project would be warehouse only.
Mr. Vatthauer explained to the Commission that the proposed project does not have enough parking for a significant amount of retail use, but there would be some commercial type use, as well. He also informed the Commission that the Phase I of the proposed project would consist of the mini-warehouse use with a possibility of some retail and commercial use.
Chairperson Simerly asked the Commission, if there were any additional questions of staff. Hearing no response, he opened the public hearing and he asked the applicant to come forward to address the Commission.
Mr. Walter Nelson, of 5613 Bluebird Ave., Dallas, representing the applicant, came forward to address the Commission. He informed the Commission that he was available to answer questions.
Commissioner Dewberry asked Mr. Nelson to verify the buildings that would be constructed in Phase I.
Mr. Nelson informed the Commission that the buildings proposed for construction in Phase I would consist of Buildings A, B, C, D, E, R, Q and S.
Commissioner Chambers askd Mr. Nelson to explain the difference in elevations for Building A and Building B.
Mr. Nelson informed the Commission that Building A and Building B has different facades on the south side of the buildings, because the proposed office/caretaker quarters would be placed in this area of Building A. He also informed the Commission that the south side of the building also faces Wintergreen Road.
Chairperson Simerly asked the Commission if there are any other questions for the applicant. Hearing no response, he asked if there were anyone else that wished to address the Commission either in favor of or in opposition to case Z-1214-10. There being no response, Chairperson Simerly closed the public hearing and he asked the Commissioners if there was any further discussion.
Commissioner Jones expressed his concern that the proposed project would be in close proximity to a major entrance to the City.
There being no further discussion, Chairperson Simerly asked the Commission for a motion.
Motion to approve Case Z-1214-10; a request to amend Planned Development 20 (PD-20) for an office-warehouse mixed use center. Moved by Vice Chairperson Donald Dewberry, seconded by Commissioner Dick North.
With the following stipulations:
(1) Exclude Contractor Shop with outdoor storage, Equipment Rental - Heavy (for storage purposes) and Heavy Machinary Sales (for storage purposes) from the list of allowable uses.
(2) No outdoor storage allowed for commercial uses.

(6) Consider Case Z-1215-10; a Specific Use Permit Request (SUP). This SUP would allow a Restaurant with Drive-Thru in the Planned Development 95 (PD-95). The property in question is located at 118 S. Cockrell Hill Road and consisting of 0.49 acres & 1 lot. The applicant is Terry Bork.

Chairperson Simerly asked the Commission if there were any questions of staff. There being no response, he opened the public hearing and he asked the applicant to come forward to address the Commission.
Mr. Terry L. Bork, 8502 Richardson Branch Trail, Dallas, TX 75243, representing the applicant, came forward to address the Commission. He informed the Commission that he was available to answer questions.
Commissioner Chambers asked Mr. Bork, how many spaces were available for lease in the building.
Mr. Bork informed the Commission that there were a total of three lease spaces at 118 South Cockrell Hill Road. He also informed the Commission that two have not been leased yet.
Chairperson Simerly ask the Commission, if there were any other questions for Mr. Bork. Hearing no response, he ask if there was anyone that wished to speak in favor of or in opposition to case Z-1215-10. There being no response, he closed the Public Hearing and he asked the Commission if there was any discussion or comments. Hearing no response, Chairperson Simerly asked the Commission for a motion.
Motion to approve Case Z-1215-10: a Specific Use Permit Request (SUP), allowing a Restaurant with a Drive-Thru in the Planned Development 95 (PD-95). Moved by Commissioner Dwight Chambers, seconded by Commissioner Reginald Jones.
Motion passed Unanimously.
