Chairperson Simerly called the meeting to order at 7:00 PM and noted for the record that six (6) Commissioners were present.

(2) Approval of the Minutes for the Regular Meeting on August 24, 2010.
Motion to Approve to Approve the Minutes for the Regular Meeting on August 24, 2010. Moved by Vice Chairperson Donald Dewberry, seconded by Commissioner Dwight Chambers.

F. PUBLIC HEARING:
(3) Consider Case Z-1207-10; a request for a Planned Development (PD-145) for Nance Farm located at 1325 Greenbrook Drive. This proposed Planned Development which is in connection with a historical structure would have a base zoning of Single Family 12 (SF-12) and deviation requests to the masonry requirements, landscaping requirements and gate & driveway requirements. The applicant is City of DeSoto.
Mr. Edlyn Vatthauer, Planning Manager, presented the management report for case Z-1207-10.
Chairperson Simerly asked the Commission if there were any questions of staff. There being no response, he opened the public hearing and asked if there was anyone in the audience who wished to speak either in favor of or in opposition to case Z-1207-10. Hearing no response, he closed the public hearing and asked the Commission if there was any discussion or questions.
Commissoner Jones asked staff to provide an explanation for removing the masonry requirement as apart of the Nance Farm Planned Development.
Mr. Vatthauer informed the Commission that the facade would consist of wood siding rather than masonry, so that the facade is similar to the time period in which the structures were originally built.
The Commission discussed the deviation to waiver the requirement to construct the proposed front gate twenty (20) feet in from the property line.
Chairperson Simerly asked the Commission if there were any additional comments or discussion.
Commissioner Chambers asked staff if there was a time frame to installing the proposed gate.
Ms. Lora Stallings, Assistant to City Manager, came forward to address the Commission. She explained that the city is still waiting for funding to install the proposed permanent fence, which will be a part of either phase two or three in the future.
Commissioner Chambers asked Ms. Stallings if the fence would be installed after the installation of the proposed parking lot.
Ms. Stallings informed the Commission that the proposed fence would be installed after the installation of the proposed parking lot.
The Commission and staff discussed funding for the vistor center, fencing and gate across the driveway.
Chairperson Simerly asked the Commission if there was any additional discussion. Hearing no response, he asked the Commission for a motion.
Motion to Approve to Approve Case Z-1207-10; a request for a Planned Development (PD-145) for Nance Farm located at 1325 Greenbrook Drive. Moved by Commissioner Dick North, seconded by Commissioner Reginald Jones.
with the following stipulations:
(1) Masonry not be required for any of the buildings on this site.
(2) The landscape buffer five (5) feet in width, with one (1) tree provided per forty (40) linear feet, not be required.
(3) The gate does not have to be located 20 feet in from the fence. However, cars cannot be pulled in facing the gate and parked in front of the gate.
(4) A masonry wall not be required between this use and the adjoining residential uses.
(5) The driveway may be constructed of a material that looks like crushed stone on the surface, but will be constructed of a base strong enough to hold a fire truck.
(6) No more than 12 cars can be parked on Greenbrook Drive on the west side of the street adjoining Nance Farm. No on street parking on the east side of Greenbrook Drive is allowed in connection with any activity occurring within the Nance Farm property. On street parking cannot project beyond the north property line or the south property line of Nance Farm.
(7) Any event that will require more than 23 parking spaces (11 spaces on site and 12 permitted on-street) must provide parking off site, for the parking needed over 23 in an approved nonresidential area.

(4) Consider Case Z-1208-10; an amendment to the Zoning Ordinance to create three (3) Mixed Use Districts. The proposed amendment would also include the area and use regulations for the Zoning Ordinance.
Mr. Edlyn Vatthauer, Planning Manager, presented the management report for case Z-1208-10 and introduced consultant Ms. Wendy Shabay and Mr. Cody Richardson from Freese & Nichols, Inc to present the Mixed Use Districts regulations.
Ms. Wendy Shabay, of 4055 International Plaza, Suite 200, Fort Worth, came forward to address the Commission. She presented an overview of the Mixed Use District project to create three zoning districts MU-1 (contemporary design), MU-2 (historic design) and MU-R (Residential component).
Mr. Cody Richardson, of 4055 International Plaza, Suite 200, Fort Worth, came forward to address the Commission. He presented the regulation standards, architectural design, parking , landscaping , screening and sign regulations.
Ms. Shabay came forward to explain the proposed three step approval process for the mixed use districts. She also addressed how the mixed use districts would affect existing businesses in a mixed use district.
Chairperson Simerly asked the Commission if there were any questions or comments for either staff or the consultants.
Commissioner Williams asked if Ms. Shabay would explain the process for a design standard waiver and the need for a conceptual plan as step one of the approval process for a Mixed Use Development.
Ms. Shabay informed the Commission of the requirements for major design standard waivers. She also informed the Commission that the conceptual plan could be an optional part of the approval process for a Mixed Use Development.
Chairperson Simerly asked the Commission if there were any additional questions of the consultants.
Commissioner Jones asked Ms. Shabay to explain the proposed standards for Mixed Use Districts that would eliminate existing businesses from expanding or remodeling their businesses each year while not conforming to the proposed ordinance for Mixed Use Districts.
Ms. Shabay explained that provisions were made to limit the number of times a business could expand or remodel within a five year period before significant changes would be required to conform to the ordinance for Mixed Use Districts.
Commissioner Chambers asked Ms. Shabay if the expansion of an existing business was based upon the square footage of the property.
Ms. Shabay informed the Commission that the expansion of an existing business was based upon the square footage of the property and remodels would be based upon the value of the project.
Chairperson Simerly asked the Commission if there were any other questions. Hearing no response, he opened the public hearing and asked if there was anyone who wished to address the Commission either in favor of or in opposition to case Z-1208-10.
Ms. Jo Judah, of 109 N. Hampton Road, came forward to ask the Commission how the proposed Mixed Use Districts would effect her property.
Chairperson Simerly informed Ms. Judah that the proposed Zoning Ordinance Amendment would only establish categories for Mixed Use Zoning Districts. He also stated that the proposed amendment to the Zoning Ordinance would not effect her property, but the city or developers could make requests for Mixed Use Zoning Developments for property throughout the City of DeSoto.
Chairperson Simerly asked if there was anyone else who wished to address the Commission on the issue. There being no response, he closed the public hearing and explained that case Z-1208-10 would be continued at the next scheduled Planning & Zoning Commission meeting on Tuesday, September 28, 2010.
