Chairperson Simerly called the meeting to order at 7:00 PM and noted for the record that six (6) Commissioners were present.
E. CONSENT AGENDA ITEMS:

F. PUBLIC HEARING:
(3) Consider Case Z-1193-10; a request for a Specific Use Permit to allow a Ice House (Kiosk) in the General Retail (GR) Zoning District. The property in question is located at 232 N. Hampton Road and consists of approximately 0.3326 acres and 1 lot. The applicant is Alan Lauhoff.
Mr. Edlyn Vatthauer, Planning Manager, presented the management report for case Z-1193-10.
Chairperson Simerly asked the Commission if there were any questions of staff. Hearing no response, he opened the public hearing and asked the applicant to come forward to address the Commission.
Mr. Jack Ryan, of 7948 East FM 4, Grandview, representing Twice the Ice, stated the benefits of having a Twice the Ice establishment in DeSoto. Mr. Ryan also stated that he was available for questions.
Commissioner North asked Mr. Ryan about the suggested price of the ice that would be sold from the Twice the Ice machine.
Mr. Ryan informed the Commission that the price of a 20 ounce bag of ice would be approximately $1.75.
Commissioner Dwight Chambers stated that the price for a bag of ice at Twice the Ice would be much cheaper than other businesses. He also asked Mr. Ryan if there would be additional lighting, other than the street lights, for the proposed business.
Mr. Ryan informed the Commission that lighting would be provided for the safety of customers.
Commissioner Roosevelt Williams stated that the proposed business is not the highest and best use for the proposed location.
Chairperson Simerly asked the Commission if there were any additional questions or comments for Mr. Ryan. There being no response, he asked if there was anyone else that wished to address the Commission either in favor of or in opposition to Case Z-1193-10.
Mr. Vandous Stripling, of 801 Sabona Drive, stated that he was opposed to the Twice the Ice business at the proposed site. He also stated that the City of DeSoto has been working to revitalize Hampton Road and the proposed business would not be considered the highest and best use for the proposed site.
Chairperson Simerly asked if there was anyone else who wished to address the Commission. There being no response, he closed the public hearing and asked the Commissioners if there was any further discussion.
Commissioner Dick North stated that the proposed business would provide a convenient and cheaper place to purchase ice for the citizens of DeSoto.
Chairperson Simerly asked the Commission, if there were any additional comments or discussion. Hearing no response he asked the Commission for a motion.

(4) Consider Case Z-1197-10; a request for a Specific Use Permit to allow a Beer and Wine Store at the southwest corner of Pleasant Run Road and I-35 E. The property in question is located at 851 N. I-35 E, Suite 102 and consists of approximately 1,466 square feet lease space. The applicant is John Chong.
Mr. Edlyn Vatthauer, Planning Manager, presented the management report for case Z-1197-10.
Chairperson Simerly asked the Commission if there were any questions of staff. There being no response, he opened the Public Hearing and asked the applicant or the representative to come forward to address the Commission.
Mr. Jay Song, of 927 Condo Drive, Coppell, representing the owner Mr. John Chong, came forward to address the Commission. He stated that he was available for any questions the Commission may have.
Chairperson Simerly asked if there were any questions of the applicant. Hearing no response from the Commission, he asked if there was anyone else who wished to address the Commission either in favor of or in opposition to case Z-1197-10.
Mr. Vandous Stripling, 801 Sabona Drive, DeSoto, Texas, stated that he was opposed to the Beer & Wine Store. He also expressed concern about the business being in operation for two months without a Specific Use Permit.
Vice Chairperson Dewberry informed the Commission that the shopping strip has parking problems.
Mr. Vatthauer explained to the Commission that the shopping center meets the parking requirements stated in the Zoning Ordinance.
The Commission, Assistant City Attorney Samantha Gowans and staff discussed the violation of City Ordinance by the Buy Low Store and the actions taken to rectify the violation of operating a Beer & Wine Store without a Specific Use Permit.
Chairperson Simerly asked the Commission, if there were any other comments or discussion. There being no response, he asked the Commission for a motion.
Commissioner Williams made a motion to deny the request for a Specific Use Permit to allow a Beer and Wine Store at the southwest corner of Pleasant Run Road and I-35E.
Chairperson Simerly informed the Commission that there was a recommendation for denial. He then asked for a second to the denial motion. There being no second, the motion made by Commissioner Williams failed. Chairperson Simerly asked the Commission for another motion.
