Chairperson Simerly called the meeting to order at 7:00 PM and noted for the record that six (6) Commissioners were present.

Motion to Approve to Approve the Minutes for the Regular Meeting on February 23, 2010. Moved by Vice Chairperson Donald Dewberry, seconded by Commissioner Van Stripling.

F. PUBLIC HEARING:
Chairperson Simerly announced a change in order of the scheduled agenda items. The cases would be heard in the following order: (5) Case Z-1188-10; a Planned Development (PD-142) for the seconde Industrial Area Planned Development and (4) Case Z-1180-09; a Planned Development (PD-140) for a Two-Family Residential Duplex (2F).
(5) Consider Case Z-1188-10; a Planned Development (PD-142) for the second Industrial Area Planned Development located north of Wintergreen Road and west of Hampton Road. This area is currently zoned Light Industrial (LI). The Planned Development will have a base zoning of General Retail with deviations relating to the Use Chart to allow some industrial uses and some changes to the height, area and placement regulations. The applicant is City of DeSoto.
Management Report for Z-1188-10
Mr. Edlyn Vatthauer, Planning Manager, presented the management report and introduced Mr. Daniel Harrison, Freese & Nichols Consultant.
Mr. Harrison summarized the history and intent of the 2nd Industrial Area Planned Development. He also informed the Commission that the Planned Development would have a base zoning of General Retail(GR) Zoning which would allow some Commercial uses. In addition, Mr. Harrison informed the Commission of the proposed uses and area regulations for Planned Development 142 (PD-142).
Chairperson Simerly asked the Commission if there were any questions of staff or Mr. Harrison. There being no response, he opened the public hearing and asked if there was anyone who wished to address the Commission either in favor of or in opposition to case Z-1188-10. Hearing no response, he asked the Commission if there was any discussion. There being no response, he closed the public hearing and thanked staff & Mr. Harrison for their collaborative effort in the Industrial Area project.
Vice Chairperson Dewberry also thanked staff and Mr. Harrision for their efforts with the Industrial area project.
Chairperson Simerly asked the Commission if there was any additional discussion or comments. Hearing no response, he asked the Commission for a motion.

(4) Consider Case Z-1180-09; a Planned Development (PD-140) for a Two-Family Residential Duplex (2F). The area is currently zoned Single Family 8 (SF-8) and the Planned Development will have a base zoning of Two-Family - Duplex (2F) with deviation requests to allow alley waivers for Lots 1-6, Block E and a minimum lot depth of 110 feet for Lots 1-5, Block B. The property in question is located west of Cedar Ridge Drive & north of Ash Grove Lane and consists of 21 lots. The applicant is Midcrest Development Corporation/ Ken Lambert.

Chairperson Simerly asked the Commission if there were any questions of staff.
Commissioner Stripling asked Mr. Vatthauer to clarify whether case Z-1180-09 would require a super majority vote from the Planning & Zoning Commission or City Council.
Mr. Vatthauer informed the Commission that case Z-1180-09 would require a super majority vote from City Council, not from the Planning & Zoning Commission.
Commissioner Chambers asked Mr. Vatthauer about the number of access points into the proposed duplex development.
Mr. Vatthauer informed the Commission that the proposed development would have three access points into the subdivision from Belt Line Road, but would stipulate another access point from Polk Street when Phase II is developed.
Commissioner Chambers asked Mr. Vatthauer about direct access to the proposed development.
Mr. Vatthauer informed the Commission that the proposed development does not have direct access to Belt Line Road. The residents of the proposed subdivision would have to meander through the existing neighborhoods to gain access.
Chairperson Simerly asked the Commission if there were any other questions of staff. Hearing no response, he opened the public hearing and asked the applicant to come forward to address the Commission.
Mr. Ken Lambert, of 172 W. Plano Parkway, Suite 221, Plano, representing LJL Development came forward to address the Commission. He informed the Commission that the proposed development would be built in two phases and the first phase would consist of six lots. Mr. Lambert also stated that he was available to answer any questions from the Commission.
Mr. Jerry Hicks, of 107 Woodlands Court , Ovilla, came forward to address the Commission. He informed the Commission that he was the owner of the property noted in the proposed development. Mr. Hicks also stated that the development would be a quality addition to the surrounding area.
Commissioner Stripling asked Mr. Hicks if he planned to sale the property after it has been developed.
Mr. Hicks informed the Commission that he would own and manage the property after it has been developed.
Chairperson Simerly asked the Commission if there were any other questions for Mr. Hicks.
Commissioner Stripling asked Mr. Hicks about the exterior construction of the proposed duplex development.
Mr. Hicks informed the Commission that he would use brick as the masonary material to meet the exterior construction requirements.
Chairperson Simerly asked the Commission if there were any other questions of Mr. Hicks. Hearing no response, he asked if there was anyone who wished to address the Commission either in favor of or in opposition to case Z-1180-09.
Ms. Barbara Landix, of 641 Missionary Ridge, came forward to address the Commission in opposition to case Z-1180-09. She stated that the proposed rezoning for 21 duplex development or 42 households would have an adverse impact on traffic and invite the potential for increased crime in the Woodlands on the Creek community.
Chairperson Simerly stated that during the work session, the Planning & Zoning Commissin discussed the alley access-connection into the neighboring subdivision and the Planning & Zoning Commission unanimously opposed the alley access-connection.
Mr. Thomas Smith, of 920 Shiloh Drive, came forward to address the Commission in opposition. He asked the Commission to preserve the quality of the surrounding area by restricting access to the alley way to the east of this development.
Ms. Anna Williams, of 920 Plantation Drive, came forward to address the Commission in opposition. She informed the Commission that the development of duplexes would impact the City of DeSoto negatively.
Mr. William Guthrie, of 332 N. Polk Street, came forward to address the Commission in opposition to case Z-1180-09. He stated that the rezoning would restrict him from having livestock on the eastern side of his property. Mr. Guthrie also expressed his concerns about Detra Road being extended to Polk Street.
Ms. Sharon Irving, of 540 Missionary Ridge, came forward to speak in opposition to case Z-1180-09. She expressed her concerns about the proposed alley connection to the Woodlands on the Creek Subdivision.
Ms. Renee Christian, of 901 Plantation Drive, spoke in opposition to case Z-1180-09. She informed the Commission that she has concerns with the increased traffic through the Woodlands on the Creek Subdivision and the safety of the neighborhood children.
Ms. Audrey Johnson, of 516 Missionary Ridge, came forward to express her concerns about the proposed Planned Development for Duplexes having a negative impact on the property value of the surrounding neighborhoods.
Mr. Charles DeCuir, of 908 Hideaway Place, came forward to address the Commission in opposition to case Z-1180-09. He told the Commission that he was concerned for the safety of his family and the potential for increased crime in the surrounding area.
Ms. Linda McAfee, of 837 Ash Grove Lane, spoke in opposition to the proposed duplex development. She stated that traffic would increase significantly and the property value would decrease in the surrounding areas.
Mr. Ivan Martinez, of 928 Hideaway Place, expressed his concerns about the proposed duplex development being a transient community and he was adamently opposed to the smaller size dwelling units.
Mr. Terry Garrett, of 901 Hideway Place, came forward to address the Commission in opposition to case Z-1180-09. He expressed his concerns for the wildlife that dwells on the property in question.
Ms. Lucy Sennes, of 629 Missionary Ridge, spoke in opposition to the duplex development. She stated that the proposed development could decrease the value of the surrounding area.
Ms. Mary Carter, of 621 Missionary Ridge, expressed her concerns about preserving the safety of Woodlands on the Creek.
Mr. Roosevelt Williams, of 920 Plantation Drive, expressed his concerns about the potential increase in traffic and crime as a result of the proposed duplex development.
Mr. Duron Wilson, of 905 Hideaway Place, came forward to express his concerns about the potential increase in crime as a result of the proposed duplex development.
Ms. Daphane Fain, of 625 Missionary Ridge, came forward to address the Commission in opposition to Z-1180-09. She informed the Commission that the surrounding communities are concerned with their investments (homes).
Mr. Terry Beatty, of 205 Idle Creek Lane, expressed his concerns regarding the size of the proposed duplex dwelling units, as well as the potential for increased traffic along those streets in the Arbor Place Subdivision.
Chairperson Simerly asked if there was anyone else who wished to address the Commission. There being no response, he asked the applicant to come forward to address the Commission.
Mr. Lambert came forward to address the Commission. He stated that Mr. Hicks would completely remove the alley access because of the concerns of the Woodland on the Creek community. He also informed the Commission that the proposed property could be developed into Single Family Residential homes, because the current zoning on the property is Single Family Residential 8 (SF-8). Mr. Lambert stated that the property would most likely be developed in some manor in the future.
Commissioner Stripling asked Mr. Lambert the reasoning behind developing the property in two-family residential (duplex) homes, rather than Single Family residential homes.
Mr. Lambert informed the Commission that the duplex market is probably better in the current market situation rather than single family development.
Mr. Hicks came forward to address the Commission. He stated that he is sensitive to the concerns of the surrounding community.
Chairperson Simerly closed the public hearing and asked the Commission if there was any discussion regarding case Z-1180-09.
Commissioner Jones stated the proposed zoning request should not be granted and the property should be development as single family residential.
Commissioner Stripling thanked Mr. Hicks and the surrounding community of the proposed development for coming to the Planning & Zoning Commission meeting to express their concern for their neighborhoods. He stated that the proposed planned development request is probably not the highest and best use for the property at this time.
Mr. North stated that the best use for this property would be single family homes.
Vice Chairperson Dewberry stated the proposed duplex development may not be the highest and best use for the property, but providing an street access to Polk Street would add to the safety of the nearby subdivision. He also stated that whenever the property is developed, the alley access to Woodlands on the Creek should not be an option.
Commissioner Chambers stated that the zoning on the property in question should stay Single Family Residential.
Chairperson Simerly asked the Commission for a motion.
