Chairperson Simerly called the meeting to order at 7:00 PM and noted for the record that five (5) Commissioners were present.

(3) Approval of the Minutes for the Regular Meeting on April 27, 2010.
(4) Approval of the Minutes for the Regular Meeting on June 22, 2010.
Motion to Approve to Approve the Consent Agenda Items. Moved by Vice Chairperson Donald Dewberry, seconded by Commissioner Dick North.

F. PUBLIC HEARING:
(5) Consider Case Z-1198-10; an Amendment to the Zoning Ordinance to revise the definition and regulations for "Community Home".
Mr. Edlyn Vatthauer, Planning Manager, presented the management report.
Chairperson Simerly asked the Commission if there were questions of staff. Hearing no response, he opened the public hearing and asked if there was anyone who wished to address the Commission either in favor of or in opposition to case Z-1198-10. There being no response, he closed the public hearing and asked the Commission if there were any comments or questions. Hearing no response, Chairperson Simerly asked the Commission for a motion.
Motion to Approve to Approve Case Z-1198-10; an Amendment to the Zoning Ordinance to incorporate state statues regarding Community Homes by amending Appendix A-3; Definitions and Section 43; Supplemental Regulations. Moved by Commissioner Dick North, seconded by Commissioner Reginald Jones.

(6) Consider Case Z-1199-10; a Specific Use Permit Request (SUP). This SUP would allow a convenience store with gasoline sales at the northwest corner of Belt Line Road and I-35 E. The property in question consists of approximately 2 lots and 8.08 acres. The applicant is Jake Petras/ Quik Trip Corporation.
Mr. Edlyn Vatthauer, Planning Manager, presented the management report.
Chairperson Simerly asked the Commission if there were any questions of staff.
Commissioner Chambers asked Mr. Vatthauer if the distance requirement for the proposed development was verified by staff being greater than 300 feet away from the church across the street.
Mr. Vatthauer informed the Commission that staff did not measure the distance, but the applicant has verified the distance requirement and would not have moved forward with this proposed development without the proper verification. He also mentioned that the applicant has not applied for a Beer & Wine license, but once the application has been applied for staff will verify that the distance requirements have been met.
Chairperson Simerly asked the Commission if there were any other questions of staff. There being no response, he opened the public hearing and asked if the applicant would come forward to address the Commission.
Mr. Jake Petras, of 1120 Industrial Boulevard, Euless, representing Quik Trip came forward the address the Commission. He informed the Commission that the distance requirement was verified. He also informed the Commission that the distance requirement is measured from front door to front door and the distance from the church across the street from the proposed front door of the Quik Trip is approximately 500 feet. Mr. Petras stated that he is available to answer any questions of the Commission.
Chairperson Simerly asked the Commission if there were any questions for Mr. Petras.
Commissioner Jones asked Mr. Petras to explain the disadvantages of having a monsard style roof on the proposed development.
Mr. Petras explained that the monsard style roof is basically half a roof which goes along the top of the building. Quik Trip does not have problems with the initial cost of the monsard style roof, but the maintainence proves to be costly over time due to fading and the difficulty of maintaining equipment located on the roof of the building.
Chairperson Simerly asked the Commission if there were any other questions or comments for Mr. Petras. Hearing no response, he asked if there was anyone who wished to address the Commission either in favor of or in opposition to Case Z-1199-10. There being no response, he closed the public hearing and asked the Commission if there was any discussion. Hearing no response, he stated that Quik Trip would be a good addition to the City of DeSoto.
Chairperson Simerly asked the Commission to for a motion.
