Chairperson Simerly called the meeting to order at 7:00 PM and noted for the record that six (6) Commissioners were present.
E. CONSENT AGENDA ITEMS:
(3) Approval of the Minutes for the Regular Meeting on December 8, 2009.
Motion to Approve to Approve the Minutes for the Regular Meeting on December 8, 2009. Moved by Vice Chairperson Donald Dewberry, seconded by Commissioner Van Stripling.
F. PUBLIC HEARING:
(4) Consider Case Z-1181-09; an Amendment to Section 34.3; D - Planned Development Requirements - of the Zoning Ordinance to remove the requirement of having a minimum of three (3) acres for a Planned Development if the lot in question contains a structure designated as historic by the Federal or State Government, or the City of DeSoto.
Mr. Edlyn Vatthauer, Planning Manager, presented the management report for case Z-1181-09.
Chairperson Simerly asked the Commission if there were any questions of staff.
Commissioner Chambers asked Mr. Vatthauer to explain how the City of DeSoto designates a site as historic.
Mr. Vatthauer informed the Commission that typically some cities have historic overlay districts, especially if the designation is done lot by lot, but these historic overlay districts are considered zoning cases. He also stated that this particular case is not a zoning case, but a case to amend the Zoning Ordinance to exclude tracts or lots containing a structure designated as historic from the Planned Development requirement of three (3) acre minimum.
Chairperson Simerly asked the Commission if there were any other questions of staff. Hearing no response, he opened the public hearing and asked if there was anyone who wished to address the Commission either in favor or in opposition to case Z-1181-09. There being no response, Chairperson Simerly closed the public hearing and asked the Commission if there was any discussion. Hearing no response, he asked the Commission for a motion.
