Vice Chairperson Simerly called the meeting to order at 7:00 PM and noted for the record that seven (7) Commissioners were present.
E. CONSENT AGENDA ITEMS:
(2) Approval of the Minutes for the Regular Meeting on August 11, 2009.
(3) Approval of the Minutes for the Regular Meeting on September 8, 2009.
Motion to Approve to Approve the Consent Agenda items. Moved by Commissioner Donald Dewberry, seconded by Commissioner Van Stripling.
Vote to Approve to Approve the Consent Agenda items. (Approved)

F. PUBLIC HEARING:
(4) Consider Case Z-1175-09; a Planned Development (PD-139) for the first Industrial Area Planned Development located north of Wintergreen Road and east of Hampton Road. This area is currently zoned Light Industrial (LI). The Planned Development will have a base zoning of Light Industrial with deviations relating to the Use Chart to permit a number of office and retail uses, changes to the minimum lot size, area and height, the decreasing landscape requirements and allowing outdoor storage under certain requirements. The applicant is City of DeSoto.
Management Report for Z-1175-09
Mr. Edlyn Vatthauer, Planning Manager, presented the management report and introduced Mr. Daniel Harrison, Freese & Nichols Consultant.
Mr. Harrison summarized the history and intent of the 1st Industrial Area Planned Development. He also informed the Commission that the Planned Development would have a base zoning of Light Industrial (LI) Zoning which would allow some General Retail (GR) and Office 1 (O-1) uses. In addition, Mr. Harrison informed the Commission of the proposed area regulations, landscape requirements and supplemental regulations for the Planned Development.
Vice Chairperson Simerly asked the Commission if there was any questions of staff or Mr. Harrison. Hearing no response, he opened the public hearing and asked if there was anyone who wished to address the Commission either in favor of or in opposition to case Z-1175-09. There being no response, he closed the public hearing and asked the Commission if there was any discussion.
Vice Chairperson Simerly stated that there has been a lot of interplay between the property owners, city staff and Commissioners regarding this Planned Development. He also stated that everyone has tried to see if we could improve the marketability and the usability of the industrial area while maintaining the integrity of the existing uses in the area. He then asked the Commission for a motion.

Vice Chairperson Simerly stated that the Planning & Zoning Commission needed to elect both a Chairperson and Vice Chairperson.
Commissioner Stripling nominated Vice Chairperson Simerly as the Chairperson for the Planning & Zoning Commission.
Motion to To elect Vice Chairperson Tom Simerly as Chairperson of the Planning & Zoning Commission. Moved by Commissioner Van Stripling, seconded by Commissioner Dwight Chambers.
