Chairperson Vaughn called the meeting to order at 7:05 PM and noted for the record that seven (7) Commissioners were present.
E. CONSENT AGENDA ITEMS:
(2) Approval of the Minutes for the Worksession on August 25, 2009.
Motion to Approve to Approve the Consent Agenda Item. Moved by Commissioner Donald Dewberry, seconded by Commissioner Van Stripling.
Vote to Approve to Approve the Consent Agenda Item. (Approved)

F. PUBLIC HEARING:
(3) Consider Case Z1174-09; a request for a Planned Development (PD-138). This Planned Development would allow for a mini-warehouse with caretaker quarters, boat & RV storage. The property in question consists of approximately 9 acres and 1 lot and is located on Cockrell Hill Road. The applicant is Don Valk.
Mr. Edlyn Vatthauer, Planning Manager, presented the management report.
Chairperson Vaughn asked the Commission if there were any questions of staff.
Commissioner Jones stated that he is not in favor of the proposed Planned Development for mini-warehouse. He also stated that the City has spent a large amount of money to widen Cockrell Hill Road and he believes the property would be better suited for general retail zoning.
Chairperson Vaughn asked the Commission if there were any other questions or comments for staff. Hearing no response, she opened the public hearing and asked the applicant to come forward to address the Commission.
Mr. Walter Nelson, of 5613 Bluebird Avenue, Dallas, representing the applicant, came forward to address the Commission. He provided some history of the mini-warehouse project and the proposed site. He also informed the Commission that the property owner has actively looked for retail users for the property with no success. In addition, Mr. Nelson explained that the property owner has been in contact with the surrounding property owners about the proposed planned development for mini-warehouse. He then asked that the Planning & Zoning Commission approve the Planned Development for mini-warehouse on Cockrell Hill Road.
Commissioner Chambers asked Mr. Nelson about the lighting around the proposed mini-warehouse facility.
Mr. Nelson stated that the development would not have pole lighting, but it would have lighting illuminating the drives. Mr. Nelson also informed the Commission that gate hours are 6 am to 9 pm and typically nobody would be on the premises after 9 pm, but special provisions could be made to gain access on the property for boat usage.
Commissioner Chambers asked about the type of material used for the facility windows that face Cockrell Hill Road.
Mr. Nelson informed the Commission that the type of material used for the facility windows on the west side of the building, facing Cockrell Hill Road, is call "Spandrel Glass". He also stated that the Spandrel Glass would be used for false windows which provide retail aesthetics only.
Chairperson Vaughn asked the Commission if there were any other questions for Mr. Nelson.
Commissioner Simerly asked Mr. Nelson about maintainence of the native grasses and wildflower area near the east property line.
Mr. Nelson stated that the native grasses and wildflower area near the east property line would be mowed periodically, but the landscaping is typically left in its natural state.
Commissioner North asked Mr. Nelson about the similarities in this facility and the mini-warehouse facility on Hampton and Parkerville Road.
Mr. Nelson stated that this mini-warehouse facility would have a different-better looking facade, but the hours of operations, policies and procedures would be the same for both facilities.
The Commission and Mr. Nelson discussed the detention pond and drainage issues.
Chairperson Vaughn asked the Commission if there were any other questions for Mr. Nelson. Hearing no response, she asked if there was anyone present who wished to address the Commission either in favor or in opposition to case Z-1174-09.
Mr. Dan Morris, of 931 W. Pleasant Run Road, representing the applicant came forward to address the Commission. He stated that he was in favor of the proposed request for a mini-warehouse Planned Development. Mr. Morris also stated that the proposed mini-warehouse would generate tax revenue for the City.
Chairperson Vaughn asked if there was anyone else that wished to address the Commission either in favor or in opposition.
Ms. LaShante' Williams, of 1248 Kensington, came forward to address the Commission. She stated that she was opposed to the mini-warehouse facility being located in such close proximity to residential districts.
Chairperson Vaughn asked if there was anyone else that wished to address the Commission either in favor or in opposition. There being no response, she closed the public hearing and asked the Commission if there was any discussion.
Commissioner Stripling stated that he would be in opposition to the proposed request, because rezoning the proposed area for mini-warehouse would be forgoing any potential retail development in the future.
Commissioner Dewberry informed the Commission that he agrees with both Commissioner Jones and Commissioner Stripling. He also stated that he is not sure a mini-warehouse is the highest and best use for this property.
Chairperson Vaughn stated that she would not be in favor of this proposed mini-warehouse planned development.
Commissioner North stated that he agreed with the other Commissioners as well. He also stated that with the widening of Cockrell Hill Road future retail development would come to the Cockrell Hill/ Belt Line Road area. However, there could be a possiblity of mixed use development along Cockrell Hill Road.
Chairperson Vaughn asked the Commission if there was any other comments or discussion. There being no response, she asked the Commission for a motion.
