D. CALL TO ORDER.
Chairperson Vaughn called the meeting to order at 7:00 PM and noted for the record that seven (7) Commissioners were present.
E. CONSENT AGENDA ITEMS:
Any item may be withdrawn from the consent agenda and acted on separately. Approval of the Consent Agenda authorizes the approval of each item in accordance with Staff Recommendations.
(2) Approval of the Minutes for the Regular Meeting on July 14, 2009.
Motion to Approve to Approve the Consent Agenda item with the modifications noted during the worksession. Moved by Commissioner Donald Dewberry, seconded by Vice Chairperson Tom Simerly.
Vote to Approve to Approve the Consent Agenda item with the modifications noted during the worksession. (Approved)

F. PUBLIC HEARING:
(3) Consider Case Z1172-09; an Amendment to the Zoning Ordinance to add the new and unlisted use "Beer & Wine Package Sales Establishment" and determine the zoning districts in which this use should be allowed. The proposed change would amend Section 36 - Use Regulations; Section 38 - Off-Street Parking; Section 34 - Supplemental Regulations and Loading and Section A-3 Definitions of the Zoning Ordinance.
Mr. Edlyn Vatthauer, Planning Manager, presented the management report.
Chairperson Vaughn asked the Commission if there were any questions of staff. There being no response she opened the public hearing and asked if there was anyone who wished to address the Commission regarding case Z-1172-09. Hearing no response, she closed the public hearing and asked the Commission if there was any discussion or comments.
Commissioner Dewberry stated that he would like to commend staff and the City Attorney for preparing such a good ordinance for Beer and Wine Package Sales Establishments. He also informed the Commission that if this measure does not pass in November at least, the ordinance will give us something to work with in the future, should the need arise.
The Commission and staff discussed the guidelines for establishing an ordinance for Beer and Wine Package Sales Establishments.
Chairperson Vaughn asked the Commission if there was any additional questions or comments for staff. Hearing no response, she asked the Commission for a motion.
