Chairperson Vaughn called the meeting to order at 7:00 PM and noted for the record that seven (7) Commissioners were present.
E. CONSENT AGENDA ITEMS:

F. PUBLIC HEARING:
(3) Consider Case Z-1170-09; an Amendment to the Zoning Ordinance to change the names and descriptions of the two industrial districts, as well as height, area and placement requirements; revising the setbacks regarding loading docks; increasing landscaping and buffers, and allowing open storage in specific areas without screening. In addition, the Use Chart is being amended to remove a number of uses, as well as adding a number of new uses with their definitions.
Mr. Edlyn Vatthauer, Planning Manager, presented the management report.
Mr. Daniel Harrison, Sefko Planning, Freese and Nichols, came forward to address the Commission. He presented a summary of what was recommended within the Industrial District Study and provide the Commission information about the purpose, objectives and changes to the Zoning Ordinance to promote quality a industrial area that is competitive with surrounding industrial districts.
Chairperson Vaughn asked the Commission if there were any questions of staff. Hearing no response, she opened the public hearing and asked if there was anyone that wished to address the Commission either in favor or in opposition to case Z-1170-09.
Mr. Gireesh Sharday, MD, of 3312 Throckmorton St., Dallas, TX 75219, representing GOGI, LP, came forward to address the Commission. He expressed his concerns about the future of his property within the Industrial Districts.
Commissioner Tom Simerly ask Mr. Sharday if his property was adjacent to Advanced Imaging.
Mr. Sharday responded by showing the Commission where his property was located on the map of the Industrial Districts.
Chairperson Vaughn ask the Commission if there were any additional questions of Mr. Sharday. Hearing no response asked if there was anyone else who wished to address the Commission.
Mr. Bill Mote, of 6330 Eldergrove, Dallas, TX., came forward to address the Commission. He expressed his concerns about the proposed changes to the use chart and how it would effect the existing businesses and potential businesses in the Industrial Districts.
Mr. Stacy Stewart, 1229 E. Pleasant Run Rd., #132, representating 4 Way Investments, seven (7) other landowners and forty-seven (47) tenants, came forward to address the Commission. He also expressed his concerns about the proposed changes to the use chart and how it would effect the existing uses and potential uses in the Industrial District. Mr. Stewart asked the Commission to stipulate that those affected uses and property within the proposed Light Industrial Districts be allowed to continue following the guidelines and regulations of the existing use chart, until the Planned Developments are created.
Mr. John Helm, 1607 Osprey Dr., DeSoto, TX 75115, came forward to address the commission. He stated that he owns a contractor shop within the proposed Light Industrial Districts and the zoning changes would negatively impact the expansion of his business.
Chairperson Vaughn ask if there was anyone else that would like to address the Commission either in favor or in opposition to case Z-1170-09. Hearing no response, she asked the Commission if there was any discussion or comments.
Commissioner Van Stripling thanked everyone that came to express their concerns.
Commissioner Tom Simerly stated that this has not been an easy task for the Commission. He states that the Commission is going to have to pay special attention to areas of the Planned Developments that involve Osprey, Falcon, Kestrel, and Executive Way and be very careful not to exclude uses that are currently working well.
Chairperson Vaughn asks the Commission, if there are any additional questions or comments. Hearing no response, she closes the Public Hearing and asks the Commission for a motion.
Motion by Vice Chairperson Tom Simerly with second by Commission Van Stripling.
