Chairperson Vaughn called the meeting to order at 7:00 PM and noted for the record that seven (7) Commissioners were present.
E. CONSENT AGENDA ITEMS:
(3) Approval of the Minutes for the Regular Meeting on January 8, 2008.
(4) Approval of the Minutes for the Regular Meeting on January 22, 2008.
Motion to Approve to Approve the Consent Agenda items. Moved by Commissioner Donald Dewberry, seconded by Commissioner Van Stripling.
Vote to Approve to Approve the Consent Agenda items. (Approved)

F. PUBLIC HEARING:
(5) Consider Case Z-1139-08; an Amendment to the Zoning Ordinance to add the new & unlisted use "Teen Club" and determine the zoning districts in which this use should be allowed. The proposed change would amend Section 36 - Use Regulations; Section 38 - Off-Street Parking & Loading and Section A-3 - Definitions of the Zoning Ordinance.
Staff Report for Case Z-1139-08
Ms. Linda Zombeck, Senior Planner, gave the staff report.
Chairperson Vaughn asked the Commission if there were any questions of staff. Hearing no response, she opened the public hearing.
Commissioner Jones asked staff about the safety measures that was discussed during the worksession surrounding the "Teen Club" use.
Ms. Zombeck stated that the recommended stipulation requests City Council to consider establishing a ordinance for the Code of Ordinances requiring security measures for Teen Club establishments.
Mr. Vatthauer informed the Commission that City Council would have to direct the appropriate staff member to research security measures for Teen Clubs. Once the research has been completed, staff would come back to Council with the amendment to the Code of Ordinance.
Commissioner Jones stated that the concerns of the Planning & Zoning Commission surrounding safety at Teen Club establishments should be reflected in the minutes.
Ms. Zombeck stated that the Planning & Zoning Commission should recommend a stipulation that the City Council consider establishing an ordinance in the Code of Ordinances to require security for Teen Club establishments.
Commissioner Stripling asked if the classification of "Teen Club" would effect a similar use at the DeSoto Recreation Center each Friday night.
Ms. Zombeck stated that there is a use classification in the Zoning Ordinance which allows public Teen Centers/Events to operate, but the Zoning Ordinance does not cover private Teen Club establishments.
Commissioner Stripling stated that the Teen Club operating in the Civic Center each Friday is operated by a private business that leases space for the club.
Ms. Zombeck stated that the public governmental agency regulates the recreation center and security is required as a part of the Parks & Leisure Services (PALS) Department rental requirement. She also informed the Commission that the requirement of security and regulation of the recreation center is not a part of the Zoning Ordinance, but a part of PALS Department rules.
Chairperson Vaughn asked the Commission if there were any additional questions or comments of staff. There being no response, she asked if there was anyone else who wished to address the Commission either in favor or in opposition to case Z-1139-08. Hearing no response, she closed the public hearing and asked the Commission if there was any discussion on the issue. There being no response, she asked the Commission for a motion.
Motion to Approve to Approve Case Z-1139-08; an Amendment to the Zoning Ordinance to add the new and unlisted use "Teen Club". Moved by Commissioner Donald Dewberry, seconded by Commissioner Van Stripling.
with the following stipulations:

(2) Change the typical age in the proposed definition from between fourteen (14) and twenty-one (21) to fourteen (14) and eighteen (18).
