Chairperson Vaughn called the meeting to order at 7:00PM and noted for the record that six (6) Commissioners were present.

F. PUBLIC HEARING:
(4) Consider Case Z-1140-08; a request to amend Planned Development 109 (PD-109) Summit Park. This proposed amendment would allow front facing garages in conjunction with side entry garages, cast iron mailboxes rather than brick and allow for roof pitches that are less than 8:12 with architectural features such as dormers, porches, patios and etc. The applicant is Goodman Land Advisors/ Eddie Collins.
Mr. Edlyn Vatthauer, Planning Manager, gave the staff report.
Chairperson Vaughn asked the Commission if there were any questions of staff. There being no response, she opened the public hearing and asked the applicant to come forward to address the Commission.
Mr. Marty Brown, of 5225 Village Creek Drive, Suite 200, Plano, representing the applicant came forward to address the Commission. He stated that the applicant would not have a problem including a black finish on the wrought iron subdivision mail boxes. In addition, he informed the Commission that the Home Owner Association (HOA)documents would encompass permanent installation and the HOA would maintain the subdivision mail boxes. He also presented a power point presentation regarding the proposed front entry options 1-5 and subdivision architectual features, gabions & elevations.
Commissioner Stripling asked Mr. Brown about the type of roofing materials that would be used for the proposed 4:12 minimum roof pitches.
Mr. Brown explained to the Commission that the builder would only use roofing materials that conform to the City of DeSoto standards.
Commissioner Simerly asked Mr. Brown if the builder has previously built the layout options three and four, because there could be possible problems maneuvering in and out of the driveways of these front entry options.
Mr. Brown stated that the builder has built the front entry garage home options three and four in other subdivisions around the Metroplex.
Commissioner Simerly asked Mr. Brown about the size of the driveways on front entry options three and four.
Mr. Brown stated that the driveways for both front entry options three and four were 16 feet in size.
Commissioner Chambers asked Mr. Brown how many lots in the subdivision would be suitable for front entry option three.
Mr. Brown informed the Commission that front entry option three would be suitable for approximately 30 lots, but home buyers would dictate the total amount of lots that would have option three. He also stated that this deviation request would give home buyers the option to build front entry options 1-5.
Commissioner Chambers asked Mr. Brown why the request to eliminate porte cochere gates was not mentioned in the initial application submittal, because it was not noted in the Planning & Zoning staff report and the Planning & Zoning Commission has not had an opportunity to discuss this request.
Mr. Brown informed the Commission that the request was not to eliminate porte cochere gates in the subdivision, but to give potential home buyers the option of adding gates at their discretion.
Mr. Vatthauer stated that staff was not made aware of the deviation request to make porte cochere gates an option for home buyers, but the Planning & Zoning Commission can discuss a stipulation allowing home buyers the option to have the porte cochere gates or not.
Commissioner Stripling asked Mr. Brown to elaborate on the reason porte cochere gates were not a part of the front entry option three.
Mr. Brown stated that the homes with the porte cochere gates would be the only homes in the subdivision with gates and this would not be in keeping with the nature of the neighborhood.
Commissioner Stripling asked Mr. Brown to explain why the builder wants to restrict home buyers from having the porte cochere gates.
Mr. Brown informed the Commission that the builder would not restrict home buyers from having porte cochere gates, but the builder would also not make it mandatory to have the gates with front entry option three either.
The Commission and Mr. Brown discussed the deviation request to allow home buyers the option to have porte cochere gates at their discretion and the Zoning Ordinance requirement to have porte cochere garages with wrought iron or tubular steel gate erected across the porte cochere opening in more detail.
Chairperson Vaughn asked the Commission if there were any other questions or comments for Mr. Brown. Hearing no response, she asked if there was anyone else who wished to address the Commission either in favor or in opposition to case Z-1140-08. There being no response, she closed the public hearing.

Motion to Approve to Approve Case Z-1140-08; a request to amend Planned Development 109 (PD-109) Summit Park. Moved by Vice Chairperson Tom Simerly, seconded by Commissioner Donald Dewberry.
with the following stipulations:
(1) Cast aluminum mail boxes be allowed, rather than masonry mail boxes. The mail boxes must remain the color black and cannot be painted another color and the mail boxes must be anchored in the ground.
(2) A minimum roof pitch of 4:12 be allowed for the following:
a. The roof on architectural features such as awnings, dormers, box windows, oriel or cantilevered
windows or bay windows.
b. Roofs in front of inset dormers and second story egress windows, as well as roofs over porches,
patios, pop outs, direct vent fireplaces, and the roof cricket.
c. Any other roof section where the horizontial distance from the wall to the outside edge of the eave
is less than four (4) feet.
(3) Lots 29-46 of Block A in Phase 1 and Lots 1-5 of Block M in Phase 2, shall be allowed to have front entry garages as denoted in Options 1-4. Option 3 must be provided with a wrought iron or tubular steel gate across the porte cochere opening, as required in the Zoning Ordinance.
(4) Lots 38 and 39 of Block A are allowed to have front facing garages (all garages), but must maintain the 25 foot front setback. In addition, the doors must be clad in wood and each parking bay must have an individual door.

(5) Consider Case Z-1141-08; an amend Planned Development 93 (PD-93) Silver Creek Meadows. This amendment would allow a tower at the entrance off Westmoreland Road. The tower will be approximately twenty-five feet in height. The applicant is Studio 13 Design Group.

Chairperson Vaughn asked the Commission if there were any questions of staff. Hearing no response she opened the public hearing and asked the applicant to come forward to address the Commission.
Mr. Leonard Reeves, of 605 Millican Drive, Lewisville, came forward to address the Commission. He informed the Commission that the proposed tower at the corner of Silver Creek Drive and Westmoreland Road would be an identification marker for the subdivision. Since the subdivision is heavily treed along Westmoreland Road, the tower would provide better visibility from the street.
Chairperson Vaughn asked Mr. Reeves if other types of identification markers were considered for the subdivision entrance at Westmoreland Road.
Mr. Reeves stated that currently the subdivision has a masonry wall with the subdivision name located on the south side of the creek.
Commissioner Stripling restated that question about the consideration for different types of identification markers other than the proposed tower.
Mr. Reeves stated that there is not enough useable land at the Westmoreland entrance of the subdivision to consider an extensive surface area identification marker. He presented the Planning & Zoning Commission with images of different tower options.
The Commission and Mr. Reeves discussed the different types of tower options that was presented to the Planning & Zoning Commission.
Chairperson Vaughn asked the Commission if there were any further discussion on the issue. Hearing no response, she asked if there was anyone who wished to address the Commission either in favor or in opposition to case Z-1141-08.
Ms. Cindy Bivins, of 417 N. Westmoreland Road, came forward to address the Commission. She stated that she was in favor of the Planned Development amendment allowing a tower at the entrance off Westmoreland Road. She also informed the Commission that the entrance into the subdivision off of Westmoreland Road is presently hidden behind trees, but a tower could possibly attract more traffic.
Chairperson Vaughn asked if there was anyone else that wished to address the Commission. Hearing no response, she asked the Commission if there was any comments or questions.
Vice Chairperson Simerly stated that once the Silver Creek Meadows is developed it will be a really nice subdivision and the tower will add a much needed identification element to the subdivision.
Commissioner Stripling stated that he would have to agree with Vice Chairperson Simerly.
Chairperson Vaughn asked the Commission if there were any additional comments. There being no response, she closed the public hearing and asked the Commission for a motion.

Mr. Robert Baldwin, of 401 Exposition Avenue, Dallas, representing the applicant came forward to address the Commission. He asked the Planning & Zoning Commission to approve the site plan, landscape plan and elevations for Mount Vernon Apartments Phase II and the renovation plans for the leasing office/ center as presented by Ms. Zombeck. Mr. Baldwin also stated that he was available for questions.
Chairperson Vaughn asked the Commission if there were any questions for Mr. Baldwin. Hearing no response, she asked the Commission for a motion.
