F. PUBLIC HEARING:
(3) Consider Case Z-1246-12; a Planned Development for General Retail (GR) located at 2115 & 2140 N. Hampton Road and consisting of 2 lots &8.83 acres. The current zoning is Light Industrial. The applicant is the City of DeSoto.
Mr. Edlyn Vatthauer, Planning Manager, presented the management report for Case Z-1246-12.
Chairperson Dewberry informed the Commission that Mr. John Freese, owner of the property in question provided a letter of opposition to the proposed request for rezoning. Chairperson Dewberry also mentioned that Mr. Freese would not be in attendance due to a scheduling conflict. He then asked the Commission if there were any questions of staff.
Commissioner Chambers asked Mr. Vatthauer to provide clarification about the previous case that came before the Planning & Zoning Commission regarding a proposed rezoning of lots 2100 & 2140 North Hampton Road, as well as, an explanation for who requested the proposed Planned Development for General Retail use at 2115 & 2140 North Hampton Road.
Mr. Vatthauer provided a brief explanation for the rezoning case of lots 2100 & 2140 North Hampton road. He also informed the Commission that City Council requested the proposed Planned Development for General Retail use at 2115 & 2140 North Hampton Road.
The Commission and staff discussed why the proposed Planned Development request was brought forward to the Planning & Zoning Commission.
Chairperson Dewberry asked the Commission if there were additional comments or discussion. There being no response, he opened the public hearing and asked if there was anyone in the audience who wished to speak either in favor of or in opposition to case Z-1246-12. Hearing no response, Chairperson Dewberry closed the public hearing and asked the Commission if there was any other discussion.
Commisisoner North expressed his concerns regarding the proposed Planned Development request.
Commisisoner McDonald also expressed his concerns regarding the proposed Planned Development request.
Chairperson Dewberry asked the Commission if there were any other comments or discussion. There being no response, he also expressed concerns about the proposed Planned Development. He informed the Commission that he preferred the previous request for General Retail zoning which would allow developers the flexiblity to develop the properties without additional expenses.
Chairperson Dewberry asked the Commission if there were additional comments. Hearing no response, he asked the Commission for a motion.
