Vice Chairperson Simerly called the meeting to order at 7:00 PM and noted for the record that six (6) Commissioners were present.
E. CONSENT AGENDA ITEMS:
(2) Approval of the Minutes for the Regular Meeting on November 13, 2007.
Motion to Approve to approve Minutes for the Regular Meeting on November 13, 2007. Moved by Commissioner Donald Dewberry, seconded by Commissioner Van Stripling.
Vote to Approve to approve Minutes for the Regular Meeting on November 13, 2007. (Approved)
Ayes: Simerly, Jones, Stripling, Dewberry, North, Chambers
Nays: None
F. PUBLIC HEARING:
(3) Consider Case Z-1137-07; rezone a 1.779 acre tract of land from Single Family 20 (SF-20) to PD-9 (Thorntree Planned Development). These 1.779 acres will be brought into Tract 5 of PD-9 and designated for Single Family as called out for Tract 5. The property in question is located on Louie Place and west of Westmoreland Road. The applicant is Wildwood Development.
Mr. Edlyn Vatthauer, Planning Manager, gave the staff report.
Vice Chairperson Simerly asked the Commission if there were any questions of staff. Hearing no response, he opened the public hearing and asked the applicant to come forward to address the Commission.
Mr. Rodney Holloman, of 1801 Richland Way, came forward to address the Commission. He informed the Commission that he was available to answer questions.
Vice Chairperson Simerly asked the Commission if there were any questions for Mr. Holloman. There being no response, he asked if there was anyone that wished to address the Commission either in favor or in opposition of case Z-1137-07. Hearing no response, he closed the Public Hearing and asked the Commission if there were any questions or comments for discussion.
Commissioner Chambers asked Mr. Holloman about the plans for the rest of the property north of the Thorntree Planned Development.
Mr. Holloman stated that due to traffic conditions and the future road widing of Danieldale Road, there were no immediate plans for further development on the rest of the property north of Thorntree Planned Development for at least a couple of years.
Vice Chairperson Simerly asked the Commission if there were any other questions or discussion. Hearing no response he asked the Commission for a motion.
Motion to to approve Case Z-1137-07; rezone a 1.779 acre tract of land from Single Family 20 (SF-20) to PD-9 (Thorntree Planned Development). Moved by Commissioner Dick North, seconded by Commissioner Van Stripling.
with the following stipulations:
(1) The Declaration of Annexation, which incorporates the 1.8 acres into the Thorntree Home Owners Association (HOA), must be signed and recorded, with a copy being provided to the Planning Department, before the plat application for the 1.8 acres can be recorded by staff.
(2) The four lots in question be excluded from the Tree Survey requirement.
