Vice Chairman McDonald called the meeting to order at 7:00PM and noted for the record that five (5) Commissioners were present.

(3) Consider Case Z-1111-07; an Amendment to Thorntree Planned Development 9 (PD-9). This amendment would reduce the garage setback to 15 feet from 20 feet for Lot 53, Block A of Thorntree Townhomes. The property in question is located north of Wintergreen Road and west of Westmoreland Road. The applicant is Matthew Arnold.
Mr. Edlyn Vatthauer, Planning Manager, gave the staff report.
Vice Chairman McDonald asked the Commission if there were any questions of staff. Hearing no response, he declared the public hearing open and asked the applicant if he wished to address the Commission. There being no response, he asked if anyone in the audience wished to speak in favor of case Z-1111-07.
Mr. William Underwood, of 1201 Sotogrande Boulevard, Euless, Texas, came forward to address the Commission. He stated that he was the architect for the proposed home at 1916 Nelson Drive. He explained to the Commission that three (3) feet of the right-hand garage stall was over the required 20 foot setback and could be brought into compliance if necessary.
Vice Chairman McDonald asked the Commission if there were questions for Mr. Underwood. Hearing no response, he asked if anyone else wished to address the Commission either in favor or in opposition of case Z-1111-07.
Mr. Philip Strand, of 1911 Nelson Court, came forward to address the Commission. He informed the Commission that none of the neighbors are in favor of breaking the Home Owner’s Association (HOA) covenant to allow the applicant’s request.
Mr. Joe Johnson, of 1864 Masters Drive, came forward to address the Commission. He informed the Commission that he was the President of the Neighborhood’s Homeowners Association and was opposed to this request. He stated that adding a home with a short driveway would pose additional safety problems in a subdivision with enough safety issues.
Mr. George Seed, of 1919 Nelson Court, came forward to address the Commission. He stated that one builder should not be given any special treatment for requirements that other builders in the past have had to deal with.
Mr. Larry Elliott, of 1809 Masters Drive, came forward to address the Commission. He stated that there are already safety issues within the community due to the narrow streets & large vehicles traveling the roads. He informed the Commission that he was opposed to adding more safety issues to accomadate one builder.
Vice Chairman McDonald asked if anyone else wished to address the Commission either in favor or in opposition. Hearing no response, he declared the public hearing closed. Vice Chairman McDonald asked the Commission if there were comments or questions for discussion.
Commissioner Simerly stated that the builder should be aware of the setback requirements, since he built a home in the subdivision previously.
Vice Chairman McDonald asked the applicant to come forward to address the Commission on the issue.
Mr. Matthew Arnold, of 7420 Ennis Brook Lane, Fort Worth, informed the Commission that its been over a year since he built in Phase III of Thorntree Townhomes and he could not remember the setback requirements on the home that was previously built.
Commissioner Simerly informed the Commission that the irregular triangular shaped lot offers a wider driveway than those lots that would be perpendicular to the street. He explains that there would be more pavement on the ground than most of the driveways in the subdivision. This would make for more paving and more functional parking than most of the lots in the subdivision but does not excuse Mr. Arnold from not knowing the setback requirements before he began this project.
Vice Chairman McDonald asked the Commission if there were any additional questions for Mr. Arnold. There being no response, he asked for a motion.

(4) Consider Case Z-1115-07; Amendment to Thorntree Planned Development 9 (PD-9). This amendment would reduce the garage setback to 15 feet from 20 feet for Lot 10R, Block G of the Townhomes of Thorntree, Phase 2. The property in question is located north of Wintergreen Road and west of Westmoreland Road. The applicant is Matthew Arnold.

He stated that the lot was small with no restriction of the total square footage on the home that could be built on the lot. He said the off street parking requirements have been met, but they would resubmit plans with changes to the home to make it fit on the lot if necessary.
Vice Chairman McDonald asked if anyone in the audience wished to speak in favor of case Z-1115-07. Hearing no response, he asked if anyone in the audience wished to speak in opposition.
Mr. Larry Elloitt, of 1809 Masters, came forward to state his opposition to case Z-1115-07. He said this request posed an even greater safety issue than the lot on Nelson Court due to this lot being on the backside of a 180 degree bend.
Ms. Jan Leigh, of 1817 Master Drive, came forward to state her opposition to the case. She said people have a tendency to drive a bit too fast for the 180 degree bend and trying to back out of this proposed driveway will be dangerous for those who pull out of the driveway as well as those drivers who are already on the road driving too fast.
Commissioner Vaughn asked if any of the homeowners of Thorntree Phase II ever backed into their driveways.
Ms. Leigh said that she was not aware of anyone in the neighborhood that backed into their driveways.

He said they often refer to the 180 degree bend as "Dead Man’s Curve", because of how dangerous it is when two cars come from each direction to pass one another. He asked that this request be denied, but would like to see the builder come back with a home that is better suited for the lot size.
Vice Chairman McDonald asked if anyone else wished to speak. There being no response, he declared the public hearing closed. Vice Chairman McDonald asked the Commission if there was any discussion.
Commission Vaughn stated that she was glad to hear the builder’s representative state they would modify their design and resubmit their plans if necessary.

Commissioner Simerly stated he would like to thank Ms. Zombeck for the extensive research accomplished on the Wind Energy Systems.
