Chairman Hudson called the meeting to order at 7:00PM and noted for the record that six (6) were present.
E. CONSENT AGENDA ITEMS:
Any items may be withdrawn from the Consent Agenda and acted upon separately. Approval of the Consent Agenda authorizes the approval of each items in accordance with Staff Recommendations.

F. PUBLIC HEARING:
(5) Consider Case Z-1104-07; a Specific Use Permit Request (SUP). This SUP would allow a 400 square foot Gazebo at 1704 Tenderfoot Lane in the Single Family Country Estates (SF-CE) Zoning District. The property in question is located north of Pleasant Run Road and east of Duncanville Road. The applicant is Ronda Loyd.
Ms. Linda Zombeck, Senior Planner, gave the staff report.
Chairman Hudson asked the Commission if there were any questions of staff. Hearing no response, he declared the public hearing open and asked the applicant if he wanted to address the Commission. There being no response, Chairman Hudson asked the Commission if they had questions of the applicant. Hearing no response, he asked if there was anyone present who wished to address the issue. There being no response, Chairman Hudson declared the public hearing closed.

Motion to Approve to approve Case Z-1104-07; a Specific Use Permit request to allow a 400 square foot Cabana at 1740 Tenderfoot Lane. Moved by Commissioner Karen Vaughn, seconded by Vice Chairman Scott McDonald.

(6) Consider Case Z-1106-07; an Amendment to Eagle Point Estates Planned Development 108 (PD-108). This amendment would allow front facing garages in conjunction with side entry garages and front facing garages behind a port cache for lots encompassed within Planned Development (PD-108) with the exception of Lot 16, Block A, which is excluded from this amendment. The applicant is Eagle Point Development.
Ms. Linda Zombeck, Senior Planner, gave the staff report.
Chairman Hudson asked the Commission if they had any questions of staff. There being no response, he declared the public hearing open and asked the applicant to come forward to address the Commission.
Ms. Blair Valk, Eagle Point Development, 5613 Blue Bird Avenue, Dallas, came forward to address the Commission. She discussed the amendment request for front facing garage and the porte cochere designs in further detail. Ms. Valk also informed the Commission that she was available to answer questions.
Chairman Hudson asked the Commission if there were any questions for Ms. Valk.
Commissioner Simerly asked if staffs' stipulation was similar to the applicant's request regarding the door of the front facing one-car garage design be required to sit back from the two car garage.
Ms. Valk informed the Commission that staffs' recommended stipulation was similar to her request.
Commissioner McDonald asked the applicant if she requested a percentage limitation on the number of lots that would be allowed to have either a single front facing garage along with a two car side facing garage or the porte cochere design.
Ms. Valk informed the Commission that staff determined the recommendation for allowing 25% of the lots to have either a single front facing garage along with a two car side facing garage or the porte cochere design.
Chairman Hudson asked the Commission if there were any additional questions for the applicant. Hearing no response, he asked if anyone else wished to speak regarding case Z-1106-07.
Mr. Randy Gaubert, with Barclay Custom Homes / Barclay Construction Group, 2408 Scenic Court, Cedar Hill, came forward to discuss the increasing popularity of the porte cochere custom home designs.
Chairman Hudson asked the Commission if they had any questions for Mr. Gaubert. Hearing no response, he asked if anyone else wished to address the Commission.
Mr. Gene Strother stated he agreed with Mr. Gaubert and thought that perhaps staffs' recommended stipulation for 25% of the lots to have either a single front facing garage along with a two car side facing garage or the porte cochere custom home design might be a bit restrictive given the taste of today's customers.
Chairman Hudson asked the Commission if they had any questions for Mr. Strother. There being no response, he asked if there was anyone else who wished to speak either in favor or in opposition of case Z-1106-07. Hearing no response, he closed the public hearing and asked the Commission if they had any questions or comments for discussion.
Commissioner North state that one of the proposed designs should not be allowed without allowing both proposed designs. He also informed the Commission that he did not see the need for a percentage of the lots to have either the single front facing garage along with a two car side facing garage or the porte cochere designs, considering the price range of these homes.
Commissioner Vaughn informed the Commission that she would like to see this Planned Development amendment approved with wrought iron gating or some type of gating in connection with the breeze way or porte cochere and eliminate staff's recommended stipulation to allow 25% of the lots to have either a single front facing garage along with a two car side facing garage or the porte cochere design.
Commissioner McDonald stated that he agreed with Commissioner Vaughn's comment regarding eliminating the stipulation to allow 25% of the lots to have either a single front facing garage along with a two car side facing garage or the porte cochere design.
Commissioner Simerly stated that the stipulation regarding the requirement for a solid wood garage door should not be included as a stipulation for either home design.
The Commission agreed with Commissioner Simerly's comment that the stipulation for solid wood garage doors would not be necessary.
Chairman Hudson stated that he wanted to be sure the design for the single front facing garage with the two car side facing garage be required to have a masonry wing wall screen.
Chairman Hudson asked the Commission if there were any other questions or comments that needed to be discussed. Hearing no response, he asked for a motion.
Motion to Approve to approve case Z-1106-07; an Amendment to Eagle Point Estates Planned Development 108 (PD-108). Moved by Vice Chairman Scott McDonald, seconded by Commissioner Karen Vaughn.
with the following stipulations:
1. A front facing garage which sits behind a porte cochere is allowed. A wrought iron or tubular steel gate must be provided in front of the porte cochere.
2. The lots be allowed to have a one-car front facing garage, as long as there is at least one two-car side facing J entry garage.
3. The door of the front facing one car garage must sit back from the two car garage such that the distance from the front property line to the door of the front facing, one-car garage is greater than the distance from the property line to any portion of the two car garage.
4. A wing wall that is visible from any public street, which is provided to screen a front facing garage, must be constructed of an approved masonry material.
