Chairperson May called the Planning & Zoning Commission meeting to order at 7:00 PM and noted for the record that seven (7) Commissioners were presents.

F. PUBLIC HEARING:
(3) Consider Case Z-1282-14; a Specific Use Permit Request (SUP) to allow a restaurant with a drive through window at 517 N. Hampton Road. The property in question consists of one (1) lot and 0.55 acres. The applicant is Juan Barbosa.

Mr. Tom Johnson, Managing Director of Development Services, presented the management report for case Z-1282-14.
Chairperson May asked the Commissioners if there were any questions of staff. There being no response, she opened the public hearing at 7:05 PM and asked the applicant to come forward. Hearing no response, Chairperson May asked if there was anyone else in the audience who wished to address the Commission either in favor of or in opposition to case Z-1282-14.
There being no response, Chairperson May closed the public hearing at 7:06 PM and asked the Commissioners if there was any discussion regarding case Z-1282-14. Hearing no response, she asked the Commissioners for a motion.

(4) Consider Case Z-1283-14; an amendment to Planned Development 147 (PD-147) to allow the north elevation to be less masonry than required. The property in question is located north of East Centre Park Boulevard and Kestrel Avenue. The applicant is Stephen Frazzitta/ Solar Turbines.

Mr. Chuck Freeman, of 1150 East Kennedale Parkway, Kennedale, with Callahan & Freeman Architects, representing Solar Turbines, came forward to address the Commission. He informed the Commission that he was available for questions.
Chairperson May asked the Commissioners if there were any questions or comments for Mr. Freeman.
Chairperson May stated that the proposed masonry material is already in use on other buildings in the City of DeSoto.
Mr. Freeman informed the Commission that he was certain the proposed masonry material has been applied to the exterior of other buildings within the City of DeSoto.
Chairperson May asked the Commission if there were any other questions for Mr. Freeman. Hearing no response, she asked if there was anyone in the audience who wished to address the Commission either in favor of or in opposition to case Z-1283-14. There being no response, Chairperson May closed the public hearing at 7:12 PM and asked the Commissioners if there was any other discussion. Hearing no response, she asked the Commissioners for a motion.

(5) Consider Case Z-1285-14; a request for change in zoning from Single Family 9 (SF-9) residential to General Retail (GR). The property in question is located at the southeast corner of Polk Street & Wintergreen Road and consisting of one (1) lot and 4.1766 acres. The applicant is Ron Cornelius.

Chairperson May asked the Commissioners if there was any questions of staff. There being no response, she opened the public hearing at 7:16 PM and asked the applicant to come forward to address the Commission.
Mr. Richard Rozier, of 209 Main Street, Waxahachie, representing Mr. Ron Cornelius, came forward to address the Commission. He provided history about the subject property and asked the Commission to consider changing the zoning from residential to general retail.
Chairperson May asked the Commissioners if there were any questions for Mr. Rozier. Hearing no response, she asked if there was anyone in the audience who wished to address the Commission either in favor of or in opposition to case Z-1285-14.
Mr. Ron Cornelius, of 1608 North State Highway, Grand Prairie, came forward to address the Commission. He informed the Commission that he is the owner of the property and would like to change the zoning back to the original zoning of general retail.
Pastor Christopher T. Willis, of 1104 Long Meadow Lane, representing Gods Exciting Cathedral of Praise Church, came forward to address the Commission in opposition of case Z-1285-14. He informed the Commission that the community and neighboring church is not opposed to the development of the subject property. He also mention that residential housing would most likely not be developed on the property, but was hopeful of compatible development for the surrounding residential community and church. Pastor Willis also informed the Commission that the property owner changed the zoning of the property from general retail to residential.
Chairperson May informed the Commission that the City of Desoto changed the zoning on the property from general retail to residential, not the property owner.
Pastor Willis, staff and the Commission discussed the church's interest in the subject property.
Ms. Julie Dosher, Assistant City Attorney, informed the Commission that sale price and the church's interest in the property in question is not a part of the zoning change request.
Chairperson May stated that the Commission should remain focused on the zoning change request and the highest & best use for the subject property. She asked if anyone else wished to address the Commission regarding case Z-1285-14. There being no response, she closed the public hearing at 7:25 PM and asked the Commissioners if there were any questions or comments. Hearing no response, she asked the Commission for a motion.
