Chairperson May called the Planning & Zoning Commission meeting to order at 7:00PM and noted for the record that five (5) Commissioners were present.

Chairperson May asked if there were any questions of staff. There being no response, she opened the public hearing and asked the applicant to come forward to address the Commission.
Mr. Bill Dahlstrom, of 901 Main Street, Suite 6000, Dallas, representing Kimley-Horn and Associates, came forward to address the Commission.
Chairperson May asked the Commissioners if there were any questions or comments for Mr. Dahlstrom. There being no response, she asked if there was anyone in the audience who wished to come forward to address the Commission in favor of or in opposition to case Z-1274-13. Hearing no response, she closed the public hearing and asked the Commissioners if there was any discussion or comments.
There being no questions or comments, Chairperson May asked the Commissioners for a motion.

(5) Consider Case Z-1275-14; a change in zoning request from General Retail (GR)/ Multi-Family (MF) to Mixed Use - 1 (MU-1). The property in question is located in an area west of Hampton Road and between Ten Mile Creek & Dalton Drive. The applicant is the City of DeSoto.

Mr. Edlyn Vatthauer, Planning Manager, presented the management report for case Z-1275-14.
Chairperson May asked the Commissioners if there were any questions of staff. There being no response, she opened the public hearing and asked if there was anyone who wished to speak in favor of or in opposition to case Z-1275-14.
Mr. Tom Simerly, of 624 Regalwood Drive, came forward to speak in opposition to case Z-1275-14. He informed the Commission that the proposed mixed use zoning change would impose heavy restrictions on the subject properties. Mr. Simerly also stated, in the event of a fire, existing businesses and property owners would be required to rebuild according to Mixed Use - 1 (MU-1) specifications and building requirements mentioned in MU-1 are more stringent than those building requirements in General Retail (GR). Mr. Simerly asked the Commission to really consider the proposed zoning change and how it would impact existing businesses and property owners associated with the subject properties.
Mr. Scott McDonald, of 1609 Tenderfoot, came forward to express his concerns about the potential restrictions to be imposed on the properties effected by the proposed mixed use zoning change. He also provided the Commission with information about the proposed mixed use district.
Chairperson May asked if anyone else wished to speak in regards to case Z-1275-14. Hearing no response, she closed the public hearing and asked the Commissioners if there was any discussion or comments.
The Commissioners discussed the effect this proposed zoning change would have on the subject properties, along with the property and business owners.
Chairperson May recommended that case Z-1275-14 be tabled for further discussion, as well as for a possible joint meeting with City Council at a later date. With no further discussion, she asked the Commission for a motion.

(6) Consider Case Z-1276-14; an amendment to the Comprehensive Zoning Ordinance regarding carports in residential areas. The applicant is the City of DeSoto.

Chairperson May asked if there were any questions of staff. She commented on discussions held in the work session prior to the Planning & Zoning Commission meeting regarding setback requirements. Chairperson May then opened the public hearing and asked if there was anyone in the audience that wished to speak in favor of or in opposition to case Z-1276-14.
Mr. Robert Barron, 1217 Stinnett Place, Desoto, TX 75115, came forward to express his concerns about the recommended changes to carport requirements in residential areas.
Chairperson May asked if there was anyone else that wished to speak. Hearing no response, she closed the public hearing and ask the Commissioners if there was any further discussion.
The Commissioners discussed changing the requirement for carports to include "a carport shall be located in the rear yard behind the dwelling, making them not visible from the street. If there is no room to accommodate the carport in the rear yard behind the dwelling, the carport shall be placed in the rear yard along the side property and facing the street. However, the carport must be set back from the rear of the dwelling the same distance as the required front setback for the appropriate zoning district. In addition, the carport must be located the distance equal to front setback from the rear of the dwelling. This measurement is made from the furthest portion of the dwelling into the rear yard to the rear property line."
There being no further discussion or comments, Chairperson May asked the Commission for a motion.
Motion to Approve to Approve case Z-1276-14; an amendment to the Comprehensive Zoning Ordinance regarding carports in residential areas. Moved by Vice Chairperson Thomas North, seconded by Commission Russell Hooper.
with the following stipulations:
(1) a carport can either be side facing/j-swing entry to rear of the main dwelling
(2) or, front facing entry, with a distance requirement being equal to the front yard setback requirement, from the rear of the dwelling to the front of the carport.
