Dr. Paul Pepe with U.T. Southwestern Medical School stated he was going to "make DeSoto the safest place to have a heart attack". Dr. Pepe presented an instructional video and then Councilmembers conducted hands-on training on the "Mini Annie" aparatus.

Clark is the Construction Manager and has been with the City of DeSoto since August 2007. He comes to us from Dallas Water Utilities, originally from Tulsa, Oklahoma. Clark currently lives in DeSoto with his wife and three daughters.

Little known fact: Clark is learning the game of golf, but his passion is football whether, watching it or coaching it from his couch.

C. PRESENTATIONS

1. Presentation of Certificates for BSW Training Consortium Graduates.

City Manager Jim Baugh, along with Andre Houser, Managing Director of Human Resources, presented the certificates to City employees
Walter Biggins, Carolyn Campbell, Keri Christiansen, Donielle Edwards, and Terry Hawthorne.

2. Presentation of the DEDC Third Quarterly Report for FY 2008.

Scott Livingston, Executive Director of the DEDC presented the FY 2008 Third Quarter Report. Also present is Perry Holloway and Michael Hurtt Directors of the DEDC.

Carl Sherman inquired about the proposed new hotel north of the Hampton Inn - whether there would be needed infrastructure.
SL - yes, gas and sewer. Water is already in place.
TJ - When Hillwood begins building number 2, there will be a water tank installed through a developers agreement.
Councilmember Valentine inquired about the new hotel and the status of the project
SL - they have met with city staff to inquire about infrastructure - they have been given application information for funding assistance from the DEDC

3. Update on and presentation of the retail committed to open in the Town Center Project.

Mayor Waddle introduced Kim McCormick of Trammell Crow who presented information regarding the retail and residential opportunities in the Town Center Project. He also introduced Ms. Mason with Prince Bistro.

Ms. McCormick introduced David Copeland with CB Richard Ellis. Mr. Copeland stated that Prince Bistro will occupy 25% of the retail space available. He further stated that leasing has been challenging due to challenging economic conditions. He remains encouraged now that construction is underway.

Ms. McCormick presented a handout showcasing the marketing program that Trammell Crow has implemented for the Town Center Project. She mentioned the temporary web site featuring the project: www.desoto.tc.com.

She stated they will begin pre-leasing in two weeks with residents occupying space in two months.

Mayor Waddle asked about the office leasing.

Ms. McCormick commented that is ongoing with the commercial side.

Mayor Pro Tem Sherman asked for clarification of retail space and if that included office space.

Mr. Copeland commented the spaces were calculated separately.

5. Presentation of the 17th Consecutive Award from Government Finance Officers Association's Distinguished Budget Presentation Award for FY 2008.

Mayor Waddle presented the award to Ms. Browder, which the City has receieved for 17 consecutive years.

Councilmember Valentine inquired if there was any discussion about security for this.

Mr. Vatthauer stated it was not discussed at the Planning & Zoning Commission meeting.

Councilmember Williams agreed with Ms. Valentine that security should be required.

City Attorney, Pete Smith, stated they can draft an Ordinance for the security issue to be considered.

Councilmember Respess clarified that security would be a separate Ordinance and asked if the language of this Ordinance was broad enough to encompass a facility that is not specifically listed.

Mr. Smith stated that was the case.

Don Dewberry, 920 W. Parkerville Road, DeSoto, commented as a member of the P&Z Commission. He commented specifically on the security issue regarding teen clubs.

Councilmember Valentine stated that her security concerns were in relation to special events when there would be a higher number of people present - such as a basketball tournament.

Councilmember Williams stated his security concerns were related to spectators at competitions.

Ms. Shipman read the agenda caption and introduced Jimmy Stephens, City Health Official, who presented the staff report.

Councilmember Respess commented the existing fees seemed to be extremely low.

Mr. Stephens stated that the fees had not been adjusted since they were established in 1991.

Mayor Pro Tem Sherman stated fast food is in medium risk and asked how that is defined.

Mr. Stephens explained that the risk assessment is based on the probability that someone could contract a foodborne illness at the facility. Certain risks are associated with certain facilities. High risk are facilities that do a high number of steps in their preparation and use reusable dinner ware. Medium risk serve potentially hazardous food but reduce their risk by using paper goods or disposable goods. All medium risk facilities have minimal preparation.

Mayor Pro Tem Sherman clarified that time invested at fast food restaurants is not as intensive as high risk facilities.

Mr. Stephens stated that most fast food restaurants have training in place that mirrors the City's food handler training program.

Ms. Shipman read the agenda caption and introduced Tonya Warren, Utility Billing Manager, who presented the staff report.

Councilmember Ledbetter inquired as to how it is determined when the meter needs to be replaced.

Ms. Warren stated it was based on the age warranty recommended by the manufacturer.

Councilmember Respess clarified that the new meters are electronically readable.

Ms. Warren stated that was the case.

Councilmember Respess asked if the readers still have to drive by to read and inquired if there are wide area readable meters in the future plans.

Ms. Warren stated that discussions have taken place, but it is very expensive. She commented further that there is testing underway in other cities.

Ms. Shipman read the agenda caption and introduced Crystal Owens, City Engineer, who presented the staff report.

Councilmember Williams asked what happens in terms of construction plans.

Ms. Owens stated that when you put infrastructure in the ground, sometimes it is not where it was planned and it goes in "as built".

Councilmember Williams asked if the City has a process in place today to avoid this issue in the future.

Ms. Owens stated that was the case.

Councilmember Respess stated this was an unanticipated expense but necessary expense and asked if this amount was certain to correct the problem.

Ms. Owens stated this was the absolute worst case scenario for this water line and she has a contractor going out this week to survey.

Mayor Pro Tem Sherman asked what the impact is on the time line for this change.

Ms. Owens stated the contractor is asking for an additional 30-45 days in order to get the water line fixed.

Mayor Pro Tem Sherman asked if the residents will be notified.

Ms. Owens stated that when they get an actual date, the City will notify residents once the contractor gets started.

Councilmember Ledbetter asked how much money is in the fund and how much will be left.

Mr. Baugh stated he did not have an answer at this time.
