A. WORK SESSION

Mayor Waddle called the meeting to order at 6 p.m.

1. Review of Master Agenda by City Manager.

City Manager Jim Baugh reviewed items on the Master Agenda.

2. Discussion of Regular Agenda items.

3. Presentation of Red Light Camera Advisory Committee recommendations.

Tom Johnson, Managing Director of Development Services presented the recommendation from the Red Light Camera Advisory Committee.

He explained the process that Traffipax used to formulate their suggestions for recommended intersections.

He stated it was the committee's recommendation to not install cameras at this time.

City Manager Baugh stated that if the committee does not recommend the installation, Council cannot proceed. However, if problems appear in the future, this issue can be revisited.

Mayor Waddle commended the committee for their work on this project.

It was the consensus of Council to leave the committee in place for such a time.

4. Update on discussions with Endeavor Real Estate Group regarding the Shops at Ten Mile Creek.

City Manager Baugh provided an update and stated he will have additional information in two weeks.

Councilmember Respess asked if Endeavor Real Estate was still engaged in talks with the City. Mr. Baugh stated that was the case.

Mayor Waddle recessed the meeting at 6:27 in order that Council may attend the reception in honor of the incoming Councilmembers for Place 2 and Place 4. Council will reconvene in regular session after that.

B. REGULAR SESSION - CALL TO ORDER

Mayor Waddle called the meeting to order at 7 p.m.

3. Ambassador: Linda Torres, Municipal Court
Linda Torres works for the Municipal Court as a Deputy Court Clerk, and has been employed by the City for 7 years. Before working in DeSoto, she worked for the City of Lancaster as an Accounts Payable Clerk.

The one thing very few people know about her is that she has a baby named Snoopy, who is a miniature schnauzer.

C. PRESENTATIONS

An additional item to agenda is the Presentation of a Proclamation in recognition of Memorial Day. Mayor Waddle presented this Proclamation.

Mayor Waddle presented the Certificate of Election to Councilmember Elect, Place 2 Patricia Ledbetter. Ms. Ledbetter then read the Statement of Elected Officer. Ms. Ledbetter’s sister, Scarlett Ledbetter-Price, read the oath to Ms. Ledbetter.

Councilmember Helm left the dais.

Councilmember Ledbetter took her seat at the dais.

Mayor Waddle presented the Certificate of Election to Councilmember Elect, Place 4 Deshaundra Lockhart. Ms. Lockhart then read the Statement of Elected Officer. Ms. Lockhart’s mother, Mary Lockhart, read the oath to Ms. Lockhart. Ms. Lockhart’s father, sister, and uncle were also in attendance.

Mayor Pro Tem Clardy left the dais.

Councilmember Lockhart took her seat at the dais.

3. Consider the adoption of City Council Rules of Procedure and Order of Business as prescribed by the City Charter.

Consider Case Z-1145-08; to amend the City of DeSoto Comprehensive Zoning Ordinance to add Regulations, Definition, and Parking Requirements for Contractor’s Shop without Outdoor Storage; to add Regulations for Barbed Wire in Commercial areas and Chain Link Fencing in Residential areas; and to amend Exterior Masonry Requirements and Parking Requirements; and adopting Ordinance.

Ms. Hallmark read the agenda caption and introduced Linda Zombeck, Senior Planner, who presented the management report.

Motion to open Public Hearing Moved by Councilmember Sherman, seconded by Councilmember Respess.

Councilmember Respess inquired about the driveway requirements for day care center and if the ordinance addresses this issue.

Ms. Zombeck stated it was the case.

Councilmember Valentine asked to clarify barbed wire on exterior side yard. Ms. Zombeck stated an exterior side yard is along a street.

Councilmember Valentine requested further clarification that residential barbed wire is already not allowed. Ms. Zombeck stated that was the case.

Councilmember Valentine asked about residential properties that already had chain link fencing. Mz. Zombeck explained they would become legally non-conforming. If the fence were destroyed or needed to be taken down, the property owner would need to replace the fence according to the Ordinance.

Councilmember Valentine inquired if there was a percentage of destroyed. Ms. Zombeck explained it was 60%.

Councilmember Respess inquired about lots that are large and deep and maybe a chain link fence makes more sense. Ms. Zombeck explained that the rear yard, if not visible from the road could be chain link.

Motion to close Public Hearing Moved by Councilmember Respess, seconded by Councilmember Sherman.

Ms. Hallmark read the agenda caption and introduced Lora Stallings, Administrative Assistant to the City Manager, who presented the management report.

Councilmember Respess inquired if the outcome of this project relies on the response of the survey. Ms. Stallings stated that was the case. He further inquired if the approval is contingent upon the outcome of the survey. Ms. Stallings stated that was the case.

City Manager Baugh thanked Ms. Stallings for the tremendous amount of work she has done on this project.

Motion to approve the Resolution authorizing the submission of an application to Dallas County for the 2008 Community Development Block Grant Program for the Wintergreen Court/Gannon Lane Repair Project and designating a representative for all matters relating to the Project. Moved by Councilmember Respess, seconded by Councilmember Lockhart.

Ms. Hallmark read the agenda caption and introduced Lora Stallings, Administrative Assistant to the City Manager, who presented the management report.

Mr. Baugh provided history about the piece of land under consideration.

Motion to approve the Resolution that authorizes the waiver of the collection of all judgment/delinquent City taxes for the land located at 600 North Interstate 35 East in DeSoto. Moved by Councilmember Sherman, seconded by Councilmember Williams.

3. Consider a Resolution adopting an Interlocal Cooperation Agreement for Regional Fire Protection Services among the Cities of DeSoto, Cedar Hill and Duncanville.

Ms. Hallmark read the agenda caption and introduced Fire Chief Fred Hart, who presented the staff report.

Mayor Waddle asked if the Council did not approve this item and the services were provided for more than 48 hours, then City would not be reimbursed. Chief Hart stated the current agreement is that the cities do not charge each other.

Mr. Baugh stated that under this agreement, if the state and federal government declare a disaster area, funds would be available for reimbursement.

Councilmember Sherman asked if 48 hours is a "magic" number for state or federal funds. Chief Hart stated it is a state standard.

Motion to approve the Resolution adopting the new Interlocal Cooperation Agreement for Regional Fire Protection Services among the cities of DeSoto, Cedar Hill and Duncanville. Moved by Councilmember Williams, seconded by Councilmember Respess.

H. CITIZEN APPEARANCES

John Ringhauser, 508 Bent Creek Drive, DeSoto, spoke on behalf of the Library Advisory Board. He announced the Scholastic Book Fair through Thursday, May 22nd at 2:00. This raises money for the library’s Summer Reading Program. The Summer Reading Program will soon begin and there will be prizes awarded.

Zakee IdDeen, 811 Timberline Court, DeSoto, congratulated the new Councilmembers and thanked the Council for their service.

John V. Sudds, 941 Prairie Creek Drive, DeSoto, introduced himself to the Mayor and Councilmembers and commented he looks forward to working with them making DeSoto a better city.

Don Gant, 1325 Aviary Drive, DeSoto, commented on the Best Southwest American Cancer Society Relay for Life held at DeSoto West Middle School on April 25th. Mr. Gant wanted the Council to know it was a great success and according to feedback, was the most successful event held in years. The event rotates among the BSW cities. Carolyn Campbell and Wanda Gardner did an excellent job.
