Jim Baugh, City Manager, reviewed the Master Agenda and items on the evening's agenda.
3. Discussion of Questions for inclusion in 2008 Citizen Survey.

Mr. Baugh and Assistant City Manager, Lynda Humble reviewed the list of draft questions to be included in the 2008 Citizen Survey.
4. Update on the USA Cycling BMX National Championships in DeSoto the weekend of March 28-30, 2008.

Parks and Leisure Services Managing Director, Renee Johnson, reviewed information regarding the upcoming USA Cycling BMX National Championships to be held in DeSoto at Metroplex BMX the weekend of March 28-30, 2008.
Mayor Waddle recessed the Work Session at 6:45. The Council will convene in Regular Session after a short break.
B. REGULAR SESSION - CALL TO ORDER

Mayor Waddle called the meeting to order at 7:00 p.m.
1. Invocation by: Kerry Moore, First Baptist Church
In the absence of Pastor Kerry Moore, Councilmember Carl Sherman provided the Invocation.
2. Pledge of Allegiance led by Councilmember Denise Valentine
3. Ambassador: Nathan Busby, Recreation Center, Parks and Leisure Services
Nathan Busby has been employed by the City of Desoto since November of 2006. Currently he is the Recreation Specialist for the Desoto Parks & Leisure Services Department. Nathan graduated from Oral Roberts University in Tulsa, OK with a degree in Business Administration and a minor in Recreation Administration.
He enjoys playing golf, playing soccer, and mentoring young people.
Nathan currently lives in Arlington. Little known fact:
Nathan recently ran the 26.2 White Rock Marathon.
C. PRESENTATIONS
1. Presentation of the 2007 Racial Profiling Report by the University of North Texas.

Dr. Eric Fritsch with the University of North Texas presented the analysis.
Councilmember Williams commented that he gathered from what he read that they are unable to make an accurate comparison with the data provided.
Dr. Fritsch replied that they have accurate data, but don’t have anything to compare it to, because they don’t have an accurate measure of the driving population.
Councilmember Williams inquired about the driving population and asked if DPS can provide the number of valid drivers licenses issued to addresses in DeSoto and wouldn’t that become more representative of driving population?
Dr. Fritsch mentioned that some cities use that measure, but the problem is that less than half the stops involve residents of the City. DPS does not have an extensive ethnicity category - only white and black.
Mr. Baugh commented that once the Census is done, the data will be more correct for the next one or two years.
Councilmember Sherman inquired if information were available on the racial breakdown of the police officers making these stops.
Dr. Fritsch commented that he did not have that information.
Councilmember Sherman said it would be helpful to include that information in the report to substantiate that one particular officer was not responsible for the majority of these stops.
2. Presentation by North Texas Tollway Authority recognizing the City of DeSoto as a Tolltag purchase location.
Joni Williams with the North Texas Tollway Authority presented a PowerPoint presentation providing background on the Toll Tag. Veronica Chasten, Municipal Court Director, will help oversee this program for the City of DeSoto.
Councilmember Valentine asked if there were other cities in the area providing this service.
Ms. Williams stated that Lancaster is currently a TollTag Vendor.
Councilmember Valentine asked how the citizens will know about this opportunity.
Ms. Williams stated that it will be advertised on the City's web site, NTTA web site, a utility bill insert, NTTA radio, and the City Lights Newsletter.
Councilmember Respess asked about signage.
Mr. Baugh commented that was a good idea.
Councilmember Valentine stated that once the Town Center Project is completed, it could be posted on the approved signs.
Councilmember Williams asked for clarification of where the TollTag works - where in Tyler would there be a toll road?
Ms. Williams stated it was Loop 49 and it was implemented within the last year.
Mayor Waddle inquired if the TollTags were able to be used on toll roads out of state.
Ms. Williams stated that they are currently in the process of making those arrangements.

Councilmember Williams inquired if he was still employed as a jailer.
Chief Brodnax stated that was the case.
Motion to
confirm the appointment of Mikel Edwards as a DeSoto Police Reserve Officer.
Moved by Councilmember Sherman, seconded by Councilmember Williams.
Vote to
confirm the appointment of Mikel Edwards as a DeSoto Police Reserve Officer.

The City Council will reconvene into Executive Session, after a short break, for the Annual Review of the Municipal Judge.
J. EXECUTIVE SESSION AND RESULTING POTENTIAL ACTION
1. Executive Session: Pursuant to Texas Government Code, Section 551.074 Personnel Matters: Annual Performance Review of the City Attorney and the Municipal Judge.
Executive Session convened at 7:50 p.m.
City Attorney, Pete Smith, was unable to attend this evening's meeting and the Annual Performance Review of the City Attorney will be scheduled at a later date.
Council resumed regular session at 9 p.m.
2. Action resulting from Executive Session regarding Personnel Matter.
It was the consensus of Council to continue Judge Kurth's service and continue with the same rate of compensation.
Mayor Waddle adjourned the meeting at 9:05 p.m.
