Mayor Sherman called the meeting to order at 6:23pm.
1. Review of Master Agenda by City Manager.
Tarron Richardson reviewed the items on the Master Agenda highlighting the City Council Mid-Winter Retreat agenda items; Master Agenda items; New Councilmember Orientation; and, Joint City Council/School Board Meeting. Mayor Sherman indicated that he will be meeting with Dr. Harris, DeSoto Independent School District (DISD) Superintendent, on Wednesday, February 6, 2013, to discuss the agenda items. Mayor Sherman also acknowledged receipt of Councilmember McCowan's suggested topic items for the Joint Meeting.
2. Discussion of Regular Agenda items.
No discussion.
3. Discussion and Consideration regarding the posting of the City Secretary and Records Manager positions.
Kathleen Shields, HR Director, gave a brief powerpoint presentation of the City Secretary job description and fielded questions and comments from the City Council. After a motion from Patricia Ledbetter and second by Deshaundra Lockhart Jones to post the position internally (which passed 4 to 3), it was the consensus of the City Council to hold a Special Meeting (Executive Session) on Monday, February 11, 2013, to further discuss.
4. Discussion of an Ordinance regulating residential locations of Registered Sex Offenders.
Due to time constraints, this item was not discussed and will be moved to the agenda scheduled for Tuesday, February 19, 2013.
5. Discussion of Ten-Mile Creek Channel Maintenance Project.
Due to time constraints, this item was not discussed and will be moved to the agenda scheduled for Tuesday, February 19, 2013.

B. REGULAR SESSION - CALL TO ORDER

Mayor Sherman called the meeting order at 7:09pm.

3. Introduction of Ambassador: Tishia Jordan, Finance Department
Tishia is a 1 year full-time employee of the City of DeSoto Finance and Accounting Department and has been in her current position of Accountant/Analyst since 2011. Prior to employment with the City of DeSoto, Tishia worked as an Audit Senior for Rylander, Clay & Optiz, LLP in Fort Worth. Tishia has lived in Grand Prairie since 2004 and loves to serve the citizens of her community and DeSoto. In her spare time, she enjoys spending time with her husband and two children attending events at The Black Academy of Arts and Letters in Dallas. Tishia is currently serving her first term as Board Treasurer of Easter Seals North Texas and Junior Advisory Member for the University of Texas at Arlington Accounting Department.
C. PRESENTATIONS
1. Presentation of Proclamation in Recognition of American Society of Civil Engineers Texas Section Centennial Celebration Year.

Ms. Morris read the agenda caption and introduced Mayor Carl Sherman who presented the proclamation. Accepting the proclamation is Sean Merrell, ASCE Dallas President, Jonathan Brower, Membership Chair, and members Marc Sandu, Ayub Sandu, Tom Simerly, John Sudds as well as Tom Johnson, Managing Director of Development Services.
D. CONSENT AGENDA
Ms. Morris read the agenda captions as well as Ordinances submitted for consideration.
Councilmember Curtistene McCowan asked questions pertaining to the Community Development Block Grant (CDBG) Project. Specifically, whether this grant will fund Code Enforcement as a new position or a position that is currently staffed. In addition, she asked if we have plans to extend this position beyond the life of the grant. Lastly, the question was raised as to whether the Use of Force policy currently exists within our Police Department or does it need to be developed and brought back before the City Council. Lora Stallings, Assistant to the City Manager, indicated that this is a new position that was approved for the 2012-2013 CDBG Program which is a full time position guaranteed for one year at a time pending funding from CDBG which is ultimately funded by HUD. This person can only perform their duties in the low to moderate income areas as established in the US Census. Once we have some months under this grant, Ms. Stallings indicated that she could compile some statistics and bring forth to the City Council for extension consideration under the 2013-2014 application in April or May depending when Dallas County funds the allocations. Joe Gorfida, City Attorney, stated that staff can review the current Use of Force policy and if needed, extend it to include the Code Enforcement position; however, at this point, it does not extend to the Code Enforcement positions that current exist.
Motion to approve items submitted for consideration with the condition to review the policy on Use of Force. Moved by Councilmember Respess, seconded by Councilmember McCowan.

Ms. Morris read the agenda caption and introduced Edena Atmore, Director of Finance, who presented the staff report.
Councilmember Denise Valentine inquired as to the reasoning in which the City of DeSoto chose Harris County Department of Education to partner. Tayo Sokale, Purchasing Manager, indicated that it is in the best interest of the City to partner with a County because the City will then be able to acquire goods and services at a more reasonable cost. However, a list has been reviewed of their items and the City is "thinking ahead" for possible future purchases.
Motion to approve an Inter-local Agreement with Harris County Department of Education to participate in a Cooperative Purchasing Program for the purpose of purchasing goods and services as provided by Section 271.102 of the Texas Local Government Code. Moved by Councilmember Zander, seconded by Councilmember Lockhart Jones.

Council discussion regarding the level of scrap metal and that the proceeds (which is set on the type of metal) will go into the General Fund for the next five years and the fact that there is no set amount that the City of Dallas receives prior to what the City of DeSoto receives. It was also discussed that the City does not have an obligation to use this agreement if there is a better price which could be obtained. The inventory of scrap metal from Utility Billing and Street Department was also discussed.
Motion to approve an Inter-local Agreement with the City of Dallas to participate in a Cooperative Purchasing Program for the purpose of purchasing goods and services as provided by Section 271.102 of the Texas Local Government Code. Moved by Councilmember Lockhart Jones, seconded by Councilmember Respess.

The following items of community interest were announced:
Deshaundra Lockhart Jones invited all citizens and staff to her reception on Tuesday, February 19, 2013 at 6:30pm in the Reception Room of the Jim Baugh Government Center (City Hall).
Denise Valentine announced a romantic comedy play in the DeSoto Corner Theatre called the Nacirema Society, staring Irma P. Hall, on weekends (Friday evening; Saturday matinee; Saturday evening; and, Sunday matinee) for the month of February until February 24, 2013. If you need tickets please call 972-572-0998 or visit our website.
Patricia Ledbetter discussed "Fun Time Live" sponsored by DeSoto Parks and Recreation on Fridays for grades 7-11. Ms. Ledbetter also discussed several events happening in the month of February as it relates to Fun Time Live.
Sandy Respess indicated that the DeSoto Public Library Department will be celebrating its 70th Birthday on Saturday, February 9, 2013 and encouraged all citizens to attend from 1pm to 3pm. This event is sponsored by DeSoto Reads and the Friends of the DeSoto Public Library.
Curtistene McCowan announced that Concerned DeSoto Citizens (CDC) will host its first College Presidents Roundtable in partnership with DeSoto ISD and the City of DeSoto beginning at 9:30am on Saturday, February 9, 2013, in the Jim Baugh Government Center. Also, CDC will present "Gospel Fest", on Sunday, Feburary 17, 2013, at 4pm, at Faith Bible Church. The admission is $10. Children ages 6 and under are free with an adult and the funds raised from this event will benefit scholarships for deserving DeSoto High School seniors.
James Zander briefly recognized the accomplishments of Councilmember Deshaundra Lockhart Jones as a member of the DeSoto City Council and indicated that her service is appreciated and she will be missed. In addition, he stated that there will be a HOA Involvement Workshop on February 16, 2013, in the Jim Baugh Government Center (City Hall) Council Chambers.
Mayor Sherman acknowledged the fitting prayer from Coretta Scott King that Pastor Curt Krohn gave, as it is Black History Month. Mayor Sherman also asked that everyone keep in their prayers the family members of Chad Littlefield and Chris Kyle. He also acknowledged members of the audience: Tom Simerly and Dick North. Lastly, Mayor Sherman announced details regarding the General Election scheduled for May 11, 2013. Three positions are on the ballot: Mayor, Place 1; Councilmembers Place 3 and Place 5.
J. ADJOURNMENT OF REGULAR SESSION
Mayor Sherman adjourned the meeting at 7:57pm and announced that the City Council will convene into Executive Session in order to discuss the annual review of the City Attorney.
