Consider a Resolution of the City Council of the City of DeSoto, Texas, finding that Oncor Electric Delivery Company LLC’s application for approval of a distribution cost recovery factor pursuant to 16 Tex. Admin. Code § 25.243 to increase distribution rates within the City should be denied; finding that the City’s reasonable rate case expenses shall be reimbursed by the company; finding that the meeting at which this resolution is passed is open to the public as required by law; requiring notice of this Resolution to the company and legal counsel; and providing for an effective date.

E. PUBLIC HEARINGS

1. Consider Zoning Case Z-1400-19; an amendment to Planned Development-109 (PD-109), to change the interior side setback to five (5) feet for several lots in Phase 2; and adopting Ordinance. The property is located approximately 425 feet north of Belt Line Road, south of Shasta Street and west of Newpark Blvd; on approximately 18 acres and consisting of 73 lots; Applicant: Jeffrey Linder; Owner: Keith Hardesty.

2. Consider Zoning Case Z-1396-19; an amendment to PD-105 to allow an Esports Arena (Amusement Arcade/Video Games) as an allowed use within a 4,452 square foot lease space; and adopting Ordinance. The property is located at 921 Belt Line Road, which is north of Belt Line Road and west of Westmoreland Road. Applicant and Property Owner: Bo Avery.

F. REGULAR AGENDA - New Business

1. Consider an Ordinance amending the Fiscal Year (FY) 2018-2019 Adopted Budget.

2. Consider approval of a contract with SYB Construction Company, Inc., in the amount of $175,704.15 for the emergency relocation of a section of sewer main along Ten Mile Creek, and establish a total project budget of $210,844.98, which includes a 20% contingency.

3. Consider an Ordinance amending Chapter 12 titled "Traffic and Vehicles" by amending Article 12.600 titled "Parking and Standing" by repealing section 12.610 titled "Reserved" in its entirety; by adding a New Section 12.610 titled "Stopping, Standing and Parking" setting forth regulations for resident-parking only zones during designated hours to coincide with official school days for the DeSoto Independent School District.

5. Consider a Resolution authorizing the second distribution of funds for the Neighborhood Grant Program (NGP) in the amount of $12,760.

G. CITIZEN APPEARANCES

The Citizen Appearances portion of the Agenda is an opportunity for the public to address the City Council on any subject. However, in accordance with the Texas Open Meetings Act, the City Council cannot discuss issues raised or make any decision at this time. Issues raised may be referred to City Staff for research and possible future action. NOTE: Citizens will be afforded 3 minutes to speak.

H. ITEMS OF COMMUNITY INTEREST

Pursuant to Texas Government Code Section 551. 0415 the City Council may report on the following items: ( 1) expression of thanks, congratulations or condolences; ( 2) information about holiday schedules; 3) recognition of individuals; ( 4) reminders about upcoming City Council events; ( 5) information about community events; and ( 6) announcements involving imminent threat to public health and safety.

J. EXECUTIVE SESSION AND RESULTING POTENTIAL ACTION

1. 1. The City Council shall convene into executive session pursuant to Section 551.076 of the Texas Government Code to deliberate the results of a security audit and the implementation of security devices/measures related to the City's outdoor warning siren system. 2. Take any necessary action as a result of executive session.
